The proposed condoloiniums are planned for 30 feet from <br /> the bank. Everything should be mored back f <br /> Referring to the plan Mr. Ki-rrane stated from the point of view of <br /> other regulatory boards , this i s a roadialbeit not constructed, but a <br /> road shown. Ms Behrman stated , - "To be abandoned . " Mr. # i rrane stated , <br /> ' hopefully ' , but that would take a vote of the appropriate board in <br /> town to abandon it . Lisa stated 'it should not thea be shown on the <br /> plans and was advised by Mr. Ki crane that it is standard practice. <br /> Ms Behrman stated here is already a driveway going across that which <br /> s impacting on It. Mr. Kicrane stated i-t was required to be left <br /> provide - access to a particular lot but now that lot is under single <br /> ownership and the usefulness of maintaining the roadway 'is no longer <br /> served. <br /> Ms ehrman stated DEQE agreed with the Commission that the edge of the <br /> coastal bank is vulnerable and should be protected. The existing <br /> structurecannot be considered- justification for this as it did not en- <br /> tall any dig ing. in the ground. Concerning the' issue of the path, she <br /> asked if it will be removed. Mr. Kirrne stated it is all washed out. <br /> Ms Behrman stated the path is eroding and will have to be corrected <br /> p-rior to any construction- as it is a natural gulley. <br /> Mr, iirrane stated he did not know if it is .-the intent of thedevelop- <br /> er to maintain that. <br /> Mr. Burns stated, to put . it bluntly, the land will not be touched un- <br /> til it is repaired to save the upland, Mr. Slavinsky agreed . <br /> Mr. Kirrane stated they are here with an application for this partic- <br /> ular structure which the present owner has owned for a short time as <br /> transfer has only taken place thl's week. If an issue that rust be add- <br /> ressed, it will be addressed. <br /> Ms Behrzan stated the AC requires a setback variance from the Board <br /> of Appeals. Mr. iii rrane stated the hoard of Appeals did in fact app- <br /> rove the relocation of the building to that site but did not give a <br /> specific variance from the ACEC. <br /> The Commission requested specifications on the drywell . Mrs. Ferriday <br /> asked for deck support plans also . <br /> M <br /> s Behrman suggested as they are going back to the Board of Appeals, <br /> they consider relocating the building fifty feet from the top of the <br /> bank . She requested specific -plans of tdie stairs and path with engin- <br /> eering,, 'i f planned to access all of the bu i l d f ags. If for usage of tete <br /> entire condo complex, it is inappropriate, A revgetation plan for the <br /> area was requested also. <br /> Sidney Stern, Walton Heath Way, asked to view the site plans and said <br /> he had no real comments. <br /> r_ NTTNtfF C FT1 T _ Anv .
