Conservation Commission <br /> November 17, 1987 <br /> Page 8. <br /> Ms Behrman advised of a comment from the Board of Health that the pool <br /> is not to encroach on the -etic system. <br /> Lisa advised the lot was not staked and was not considered. However, <br /> lot of abutters have called and are now present. <br /> The chairman stated the commission will continue with the hearing but <br /> normally would continue if the lot was not staked . There will be no <br /> decision toniht. <br /> Ms Langhaser stated it was an error on her part. She would be milling <br /> to continue. Abutter receipts were presented. She presented drawings <br /> .of a Gunnite pool and specifications of the filtering system. A 20 X <br /> 40 foot pool is proposed within 22 feet of the top of a coastal band <br /> on an abutters property, a park reservation area. The pool will be en- <br /> closed with a brick terrace and a small retaining wall and fence. To <br /> be removed 'are a flagstone patio walk, --shower and a small part of a <br /> .patio, Concerning the Board of Health comment, distance has been <br /> maintained to a 10 foot minimum from the location of the septic <br /> system. A 20 foot minimum will be Maintained from the edge of the pool <br /> to the leaching area. If the tank or leaching facility are closer than <br /> the minimum, they will be Moved and they will go before the Board of <br /> Health. The proposed brick patio and terrace are brick set in sand . <br /> Ms Behrman stated if the location of the septic system changes, it <br /> will be necessary to come back to the Commission . <br /> Mr-s.. Jacobson stated they will be within 2 feet of the property line. <br /> Ms L angha ser stated they are requesting a variance from the Board of <br /> Appeals but do not have it in hand. The Building Inspector has stated <br /> as this is an inground pool it is not considered a structure. <br /> Kevin Kirrane stated, from a zoning perspective, the swimming pool <br /> does nat meet the definition of a structure under the zoning bylaw and <br /> does not have to meet the zoning setback. <br /> Hs Behrman questioned an existing Order of Conditions on the property <br /> and requested the DEQE number . <br /> C."OMMENTS FROM ABUTTERS: <br /> James <br /> BUTTE S- <br /> Janes Collins , representative of Pock Landing Park o . , Inc . ,, of <br /> which Mr. Crock is a member asked to speak. Also present from the <br /> Association were Mr. & Mrs. Jerry Carter and Fred LeBlanc. He stated <br /> they were concerned with the location of the pool relative to the <br /> association property, as well as abutters property and also, how they <br /> will access to put in the pool . He questioned how they will protect <br /> the coastal zone and the bluff , a very delicate environment . <br /> Jerry Carter stated that maybe a pool isn ' t a structure but with a <br /> deck and fencing would become a structure. Also, there is a buffer <br /> zone that runs all alons the association property consisting of ' of <br /> the homeowner and - 0 ' from New Sbuy Corp. He suggested that this <br /> pool would encroach - on that 60 ' buffer zone which is stated to not b <br /> a buildable lot. <br />
