He further advised that Roca Landing Park Assoc . was not notified of the hearinS. Ms Langhauser stated the association is not listed with the assessors as an abutter. 'fir. Colliers pointed out the 5 lots the association pays takes for.. Mr. Kirrane stated this is not within the purview of the Commission. If in effect there is a limitation as to what can or cannot be built on that lot , that is between those who have or do not have rights on the respective lot. in question. Mr.. Collins stated the concern is that the lot with the proposed pool is 22 feet from the bluff and in order to put the pool in the lot will have to be stripped and the apron will leave no Preget-ation and will be the same as what happened up in Maushop Village and at Niren erg' s property. it nberg' s has eroded, Maushop is fallina down to the point where it i a hazard and this is 22 feet from a very delicate coastal zone,. Their other concern is, within this 300 foot arca every single house is served by an on-site well . Bringing in pools with chlorine and other associated chemicals , where will they drain and the run-off will hurt the bluff. die questioned how they will Set in to excavate the 200 yards and bring in the material to. build the pool . Ms Behrman stated a request will be filed for TownCounsel ' s opinion whether this is a proper zoning matter, as if it is it will have to be acted capon by the Board of Appeals prior to Commission action. Mrs . Ferriday questioned. whether the matter should be heard without the abutters notices. Ms Behrman stated as an abutter she would strongly voice -an objection. VOTE: Carol Jacobson made a motion not to hear the application until the abutters have been properly notified . Seconded by Mr . Surns.
