Martick staged wells in an area where there is salt in rus,,ion <br /> have to be drilled after a few years as other wells on the street have <br /> been and therefore must be accessible; <br /> Y <br /> HEARING CLOSED <br /> : 3 - Donald Shapir (Braman En r. Co . ) To construct a pool , deck <br /> with steps, fence, outside shower and landscaping at Lot 4 Tide Run . <br /> Construction will take place within an ACEC. Abutters receipts were <br /> presented. Doug Cameron presenting. The area of construction presently <br /> consists of a deck and cleared area. Two oak trees will be framed into <br /> the deck. 60 cubic yards of material are to be excavated and removed <br /> from the site. There will be no Brading. Access for construction equip- <br /> met' ill be on the northwest side of the house and has been staled. <br /> Any shrubs removed in that area will be replanted. The work limit is <br /> to be a row of staked haybales placed in a .tr nch 4 feet deep to <br /> provide better siltation protection., <br /> Ms Behrman stated h ybales are sufficient and a trench is not <br /> necessary. <br /> Mr. Cameron stated the project is. in the ACEC and the el-evatlon is the <br /> ll foot contour. An application is in to the Board of -Appeals and <br /> EA. There. have been no approvals to date. <br /> i <br /> Ms Behrman advised the Commission can deny the project .as local <br /> permits have not been obtained Mr . Cameron requested an indefinite <br /> continuance. <br /> Ms Behrman stated a lot of excavation will be done inear the tree to sae <br /> saved. They are bein8 optomistic in the attempt as that is the deep <br /> end of the pool . Also, concerning the outside shower, .she asked if <br /> Board of Health approval was in hand and Mr. Ca e-ron stated it was <br /> not and application had not been rude. <br /> Mrs. Ferriday suggested putting %he pool in f o tf fir. Cameron stated <br /> they have an existing deck area that they would like to maintain use <br /> of as that is the view, <br /> Ms Behrman pointed out the existing Order of Conditions on the house <br /> specifies all existing deck labor was to be done by hand. This request <br /> would be reversin8 a stand in allowing heavy equipment back there . It <br /> is heavily vegetated and the bank is necessary to contain flood water . <br /> This is below the ll foot contour and concern is sufficient to <br /> regulate that structures in the 11 foo,t flood velocity zone have to be <br /> on pipes and this would be puttinZ in a harrier . <br /> Mr . RosenberZ stated if someone was pu t w i ns in a house , the commission <br /> would not allow a- foundation. This would impact on the bank and on <br /> abutter ' s properties . <br /> Mr . Cameron stated part of the application was based on the previously <br /> filed permitted and approved projects similar to this . He could not <br /> name them but staters they raid . research this. Ms Eehrman requested h <br /> brinS the references in and advise when they were done . <br />
