Conservation Commission <br /> Meeting of ,January 21 , 1988 <br /> Fuge 3. <br /> Lisa stated Mr. Orlow has advised he had been told b 'Oz" they are <br /> not going to apply for a license to acquire the drainage easement. <br /> They will continue to " let things happen naturally, as they have in <br /> the past. Subsequently Col . Brogna w'a's called and he stated the prior <br /> evenins in Washington he was briefed on what to say at the public hear- <br /> ing. Mr. Orlow was thea called and asked for written confirmation and <br /> without that confirmation the public hearing would still be held and <br /> the questions that Town Counsel had sent them months ago would be read <br /> as well as the questions from the Commission. He was informed Rep. <br /> Cah i r and Michael Forest from Congressman Study! ' s office would attend <br /> and the hearing would be held unless confined in writing from him . He <br /> stated he understood. Town Counsel agreed with this approach. The meet- <br /> ing will be held Tuesday night, .January 26 at 7: 30 . <br /> Fir. Rosenberg stated the Commission will want a plan of the proposed <br /> license area and the right to annual information on water quality in <br /> the future. <br /> ?ave Sani ki appeared for the Ba aro hearing and was advised o the <br /> continuation. He stated the package was f1led through his office and <br /> as agent h was not notified. Recognizing there is legal action, that <br /> is a separate matter. Ms Behrman stated as he and Kevin Kirrane appear <br /> ed at the hearing together, it was assured things were being coordin- <br /> ated between offices. <br /> He advised the lot was staked as the Commission requested . <br /> - Dr. Furry Fel ger (BSC Croup) To construct a 4' wide by 145 ' <br /> long wooden pier with float and ramp entering into I aquoit Bary ACEC at <br /> Lot 18 Tide Run. Andrea Langhaser presenting. Plans and abutter rec- <br /> eipts were presented. This is a continued hearing for an original re- <br /> quest on 4/167. A longer pier on the sane site was denied locally <br /> and approved at DEE superceding level . The pier at 14 ' from within <br /> the upland to 38' beyond Mean Low Water was approved by DEQE, ACOE and <br /> Waterways. The Board of Appeals has granted both the special permit <br /> and a variance from the length restriction to allow 100 ' from dean <br /> High Water. A shellfish survey was requested and Dave Ryan felt the <br /> only shellfish present were softshell clams and quahogs with numbers <br /> so minimal they were not -worth doing a survey. The pier is 3"10" wide, <br /> 3' 10" off the marsh 5-1/2' above low - tide and does not interfere with <br /> navigation. It is for the recreational use of the Felger and .as a <br /> livery boat station. The only boats to be tied up there will be a l ' <br /> Zodlak or Sunfish. A larger boat they own cannot be moored there. <br /> Lisa advised the Shellfish agent stated shellfish in the area is not <br /> plentiful but he should be contacted to remove them from the area. Ms <br /> Lan ghauser agreed to contact him before construction . <br /> 1r . Rosenberg pointed out on the plan is an ' observed low water <br /> mark and asked if there will be a neer low grater mark staked. <br /> Ms L.anghauser stated the edge of the marsh and vegetation will be curr. <br /> ent. <br />
