Baxter stated, as far as the replication plan, that was put together by a biolo- <br /> gist they use and it was left up to him to plan. He was made aware of the concerns <br /> for trying to use nursery stock. It is his experience that we should have some luck <br /> with existing vegetation. A bi-annual inspection is called for and if a problem with <br /> any transplanted plants, we would then call upon nursery stock. <br /> Lisa pointed "out that he agrees in the write up that the stook has a better survival <br /> rate. <br /> Mr. Banter stated he feels it would be satisfactory to go with the existing veget- <br /> ation. You still have the guarantee the area will act according to it's design. <br /> If a failure with the plants, they will be monitored on a b i-annual basis and i <br /> a problem, corrective action will be taken. <br /> Mr, Kirrane stated if the Commission feels that it is appropriate to deal with that <br /> on that basis, it can be conditioned. <br /> Mr. Rosenberg stated if you request to close the hearing, we will have no choice <br /> but to do that and will take our action as required under the statute. <br /> Mr, Kirrane stated he has conferred with his client and they understand there is <br /> always the possibility that during the subdivision process, the Planning Board <br /> right request a change at which point they will be under an obligation to come <br /> back to reapply or seek a modification to any order of Conditions. At tho present <br /> time, they would prefer to complete this process. <br /> There were no further questions and no comments from the public. <br /> HEARING CLOSED <br /> 8:00 - Michael Moore., lot 777 Fells Pond Road. W .M, arwick, Susan Annus present- <br /> ing. Proposed is construction and maintenance of a three bedroom dwelling and elev- <br /> ated wood deck within 100 feet of Fells p6ndf - <br /> Lisa stated, after the onsite, we had talked about the haybaie area not being <br /> staked and the corn issibn -'requires the' stru ture to be staked and the work limit <br /> be shown on the plan, not the work limit to be stared out and Susan was told the <br /> Commission wanted the contours continued down the bank. <br /> Ms Behrman stated this requirement has been in effect for some time and her firm <br /> Is well aware of this. <br /> Lisa asked the - mu nt of fill . Ms Asmus stated there would be no cut or change in <br /> grade. :. <br /> Ms Bhrman questioned the dotted line and was told it is the top of the bank. <br /> Ms Asmus stated the proposed hayba es are the limit of work. All scarified areas <br /> will be revegetated. Drwells are proposed. Dr, eway to be of pervious material . <br /> The bank is densely vegetated and she feels there will be no adverse effect to it, <br /> No work will be further seaward than 5 feet over the bank. <br /> The entire commissionq uestioned work over the bank. Ms Asmus stated, yes, a small <br /> portion. Mr. Rosenberg stated 7 -- of it will be over the bank. <br /> Mrs, Jacobson asked if the sono tube work would be done by hand and Ms Asmus stated <br /> it would. <br />
