unser vat-ion Commission <br /> January 5, 1989 <br /> Page 2. <br /> 8: 15 Dr. Lawrence Herman (BSC Group) for landscaping approximately <br /> 400 S.F. of lawn with indigenous plants and construction of a <br /> retaining wall and stairway within the buffer zone at 40 Uncatena <br /> Drive. Dorman Hayes presenting. The Chair man gave a narrative of the <br /> history covering the Enforcement Order and Legal Complaint. This is <br /> an after ' the fact Notice of Intent requesting the work as-built be <br /> pe.ritted with restoration mitigating measures. Areas altered were <br /> 410 S.F. of lawn and 1330 S.F. of open scrub and wood chips. They <br /> propose the area south and east of the railroad tie wall be replanted <br /> with indigenous shrubs consistent with the shrub buffer currently <br /> growing along Dean' s Pond northwestern boundary. It is further <br /> requested said replanted buffer be allowed to grow wild but be period- <br /> ically maintained under a three year maintenance program. They ask to <br /> permit the stairs, wall and landscaping northwest of what will be <br /> replanted shrub buffer. Sod will be removed and field fescus allowed <br /> o grow to the height of 4 -- 6 laches, except for a b foot swath <br /> parallel to the tide wall an' d a 4 foot grass path existing from the <br /> stairs to the replanted shrub buffer. This is requested in order to be <br /> able to Griew the wild life activity. No pesticide or fertilizer s will <br /> be used. Haybales will be used to control erosion and prevent impact <br /> on Dean' s Pond resources, <br /> Hr. Mayes presented photos of the area. He advised the area is to be <br /> replanted with huckleberry , choi eberri s, wild and swamp azaleas, <br /> inkberries and viburnum. He will provide a list. The maintenance <br /> program suggested is due to indiscriminate pruning that has tarn <br /> place on adjacent lots and the branches that have been thrown into the <br /> buffer. This would allow Dr. Herman, with the assistance of an <br /> arborist, to create vistas through the growth. This has been outlined <br /> in the Notice of Intent. No organic fertilizers will be used. <br /> Hs Behran stated she was confused with the numbers on the plan an-d <br /> asked if they were topographic elevations. Mr. Hayes stated he would <br /> assure so. <br /> Mr. Burns questioned how the lawn would be removed. Mr. Hayes stated <br /> by hand. Haybales will be put down, a TroybuiIt brought in to rototill <br /> it up and thea carted out in wheelbarrows. <br /> Mrs. Jacobson stated, given that the bulldozer was in the pond 'the day <br /> the commission discovered the work being done there, she has <br /> reservations. <br /> Mr. - Burns referred to the two tiers and a stone leaching and asked <br /> what it was for. <br /> Mr. Hayes stated it is to highli8ht 'the landscaping, aesthetics. <br /> Mrs. Simmons stated it has to be for runoff and drywells will be <br /> needed. <br /> Ms Behrman questioned the 4 foot path. Mr. Hayes stated it will come <br /> down the st airs right to the edge of the buffer, to put a chain and <br /> watch the wildlife. <br /> Hs Behrman stated she felt a proper topographical map was needed. <br /> Also, the Commission is looking at an as-built but Mr .
