40 <br /> Conservation Commission <br /> January 26, 1989 <br /> Page 6. <br /> 'Agostino: 11/3/88 closed pending plans. <br /> TE= Motion made and seconded to issue a negative determination. <br /> Isabel Baldauf: Order of Conditions issued. Proviso: Any' bulkhead <br /> repair or dredging would require application to the Commission. <br /> John Fitzsimmons: Order of Conditions issued. <br /> Jahr Sans Trust: Lisa reported on the a,ju icator ► hearing. DEQE <br /> counsel advised the applicant had not been notified. He suggested <br /> staying the hearing until the local bylaw is settled in superior court <br /> Lisa did not agree as this is two separate laws. -It was also noted. <br /> there is no superior court ease filed. <br /> Lisa advised Paul Somerville felt it would be easier to make a state- <br /> ment against it if the whole structure had been denied. He also <br /> suggested waiting until -we get something with a better case. <br /> Mrs. Marsters stated if the ajudicatory hearing has been stayed, they <br /> are in limbo and suggested waiting for -the letter of decision to stay <br /> the ajudi a o r hearing and then file an appeal . <br /> Ms Behrman suggested talking with the Conservation Law Foundation and <br /> Mass. Association of Conservation Commissions. <br /> VOTE: Notion made acrd- seconded to authorize Lisa Hanscom to appeal the <br /> stay. <br /> The Chairman advised Lisa is leaving the Commission to 8o to work for <br /> Cpm. <br /> A job description was previewed. Lisa suggested free advertising of the <br /> position in the MACC bulletin. She stated she will work full time <br /> until the 16th of February* With vacation days and comp. time she <br /> could work 20 hours per week until April Ist or until replacement is <br /> found, <br /> The Commission thanked Lisa for her loyal service for the past year <br /> and one-half. <br /> Johns Wand Park Survey: - There is $5800 in the survey account; the low- <br /> est bid is $12, 000, leaving a deficit of $6,7, 000. Toe Murphy suggested <br /> Setting it now out of the engineer' s account and at the end of the <br /> fiscal year, if needed, take it out of the cranberry account and put <br /> it back into engineering, <br /> It was agreed the logical place to get the funds is from the town' s <br /> legal and engineering account. A mend to be seat to the selectmen <br /> prior to the nett selectmen ' s meeting. <br />
