AT THE REQUEST OF THE APPLICANT . 7 : 31 Michael Moskowitz , Lot 52 Pppnsst Island Road , SE 43-763. Request for an amended order of conditions to add a second story within the same footprint . A wall was changed in the basement and the Board of Health stated this could b construed as a bed- room so this was changed to a five drr situation , The cess- pool is being ripped out and filled as it is going i nto the ground water . Ms B hrman read from a letter asking to move a tree . She started the tree has already been removed , not moved . . Slavinsky stated documentation is in hand from the Corps of Engineers that the dock is grandfathered . Ids Behr main stated there should be a request for Determination of' Applicability , if not a filing . It cannot be denied but the Comm- ission omm- issiori has an obligation to condition the work 1r. Burns advised there are two new pilings put up that are creosoted . Mr . S l av i n sky advised there is a plan i n the works to charge the stairway . Ms Dehrman suggested a letter be sent to fir . Moskowitz that although his dock is grandfathered , if repair work is needed he should be coming before the Commission . HEARING CLOSED - ORDER OF CONDITIONS IN 21 DAYS . Phyllis L i tt l efo rd , Quashnet Road . John S l av i nsky advised this is a failed cesspool overflowing into the bog . They propose to replace immediately with a Title V system. A new well is proposed also . The old cesspool will be pumped and fi l led . Mr . Coffey suggested a concrete truck filled with wet sand to shoot it into the cesspool would have no impact on anything around it . Mr , Slavinsy agreed . Mr . Rosenberg suggested a negative determination be issued based on the plan . VOTE : Motion rade and seconded to issue a Negative Determination . 7 :45 Joseph Car i g l i , Lot 520 Triton Way , Continued from 2/23/89 , Bob Burgmann of Holmes & McGrath presented plans and information on the wall provided by the landscaping c mpany .
