conservation commission
June 1 , 1988
Page 6 .
what was there was L-shaped . He reviewed the records at Army corps .
of Engineers . This is the dock as built and is actually larger .
Mr , Rosenberg stated the question before the Commission is what was
there in 1987 and whether there has been a change or addition to what
was tonere in 1987 .
ttY Fox stated the answer is yes . The problem is the neighbor thought
there was a smaller structure there with a smaller boat when in fact it
was a larger structure there prior to 1987 .
Mr , Eurtis stated most of the permits coming' before him have permission
to build and maintain which doesn ' t say who to notify or what to do about
that . When he vent to the site there was a float , one piling and two
eyebolts on the end of the float and there were signs of pilings out
further into the water .
Mr . Rosenberg asked if there were any pilings there?
Mr . Eurtis stated no , but there were holes and you could see where
the ice had lifted them out and the ti-de carried them away . This
dock was not usable the way it was ,
F
Mr , Burns advised there are a total of four pilings there today , that
dock has been extended .
Mr * Sherman advised the town planner gave him a 1981 aerial photo which
shows a noticeable discrepancy between the two sizes . He measured both
docks since the last hearing and they are within 6-8 feet of each other
but the 1981 photo shows the Moskowitz dock being considerable shorter
than the adjoining dock . He seat photo copies of those to DEE and
Army corps . of Engineers and has not heard back from them .
Atty .. Fox stated ghat was there in 1987 was not an L-shaped dock .
Mr . Rosenberg stated this is a very narrow area .
Mr . Burns stated it is not a navigational hazard .
I
i
Att « Fox asked if Mr , Moskowitz would be permitted to build what was
there before , an L-shaped dock .
Mrs * Marsters stated she would think he could build what was there be
fore the act .
Mr , Rosenberg added , if they can get anything which would give the
Commission the dimensions of what was there .
Atty * Fox stated he tried , he spoke with the previous owner who gage
hire ars affidavit only stating that it was done in 1961 , unfortunately
she didn ' t have any record ofthe dimensions . If you put a large boat
at the end of the L-shaped dock , would it not protrude as far into the
waterway?
Mr . Rosenberg suggested a Notice of Intent be filed with respect to
the whole thing to regularize this once and for all with a plan on
record . There is specific evidence to say that tonere was a change
and elongation of the dock as it stood . We do not have anything in
the way of dimensions to measure that against .
