Conservation Commission <br /> i <br /> June 15 , 1989 <br /> Page 5 . <br /> Mary Marsters was acting chairperson . <br /> 7 : 30 Dale & Deborah Dougherty , to add a second story to an existing <br /> dwelling and extend 10 feet to the from at 67 Ninigret Ave . Abutters <br /> receipts were presented and revised plans showing a tree to be removed <br /> and haybales added . <br /> Ir . Burns advised there is a cluster of three trees with one root which <br /> will be involved . Mr . Sherman agreed <br /> Mrs . Simmons asked if there was a fence and , vas told there was not. <br /> Mrs , Wall stated there is a board that goes beyond their boundary line * <br /> Mrs . Dougherty stated she would be willing to open that . <br /> Mrs . Marsters asked how they propose to dig the crawl space out's <br /> Mr . Dougherty advised with a bobcat . <br /> Carol Jacobson , an abutter , stated she has no problem with it , the <br /> land is very flat . <br /> The revised plan is to be sent to DEE . <br /> FEARING CLOSED , ORDER of CONDITIONS IN 21 DAYS . <br /> 7-:45 Michael Moskowitz , 146 Popponesset - I s l and Road , Conti n ued hear i ng . <br /> Elliot Rosenberg was acting chairperson . Dave Sanicki of Cape & Islands <br /> Surveying advised revised plans were submitted by letter . it is pro- <br /> posed to relocate a set of stairs to align with ars existing structure , <br /> At the last hearing , the Commission had no objection of the_ proposed <br /> relocation . It was requested ars additional 4 feet be added to the <br /> landing at the top of the bank . <br /> Concerning the question of whether the existing structure was permitted , <br /> information from his fi lel was submitted to the Commission , <br /> Mr . Moskowitz is present to address the question along with his attorney <br /> Jim Fox . <br /> Mr . Rosenberg stated the record of the hearing on May 18 indicates <br /> question was raised whether or not an addition to the dock had been <br /> placed on the property during the last ,year . This question was asked <br /> of the applicant and the record indicates there was no answer . It is <br /> in the State regulations and regulations of the Commission that while <br /> there is an either unpermitted or incomplete project , no further <br /> application will be accepted or acted upon by this Commission . What <br /> was permitted and how that compares with what is actually there at <br /> the moment would be the preliminary question that has to be decided . <br /> Atty . Fox stated he dealt initially with Argy Corps . of Engineers <br /> when this issue carne -up. When Mr . Moskowitz bought the house he hired <br /> Little River Boat Yard and he was told that as long as he built what was <br /> there he could do this . He asked Jonathan Burtis to come along tonight <br /> to explain this . He also went to Army Corps , of Engineers . He showed <br /> an 1972 aerial photo of the initial dock which was there which seems <br /> to be larger than what ' s there now. It was an L-shaped cock and two <br /> floats were there . Mr .
