MASHPEE CONSERVATION COMMISSION
MEETING of JUNE 291 1989
Commissioners present. Gertrude W. Simmons,, V. Louise Beh ran, Joseph Burns,
Elliot Rosenberg, Mary Marsters and Patrick Coffey.
Also present were Robert Sherman, Conservation Agent and Associate members
Elizabeth Terry and Florence Wall .
The meeting was called to order at 0 p.m.
30 George M. Wise, 16 & 16A o kway Bay Rd. } Continued from May 18, 1989, Todd
Palmatier presenting. At the original hearing a 20 scale plan was requested and
relocation of the wetland line which is closer to the path than originally. A
profile down the bank was drawn as requested. The Gunnite pool will not be as
deep as a conventional pool with less excavation. Approximately 40 yards of fill
will be taken out. When asked if the pool will be raised from the back of the house,
he stated no, it will be exposed.
Mrs. Simmons stated they are right at the lip of the bank and suggested the pool b
moved in order not to destabilize the bank.
Mr. Palmatier stated that is where Mr. Wise, who was present, wants the pool for
reasons of privacy.
Mrs. Simmons stated she would have difficulty with the pool the way it is. She
asked M . Wise if he would consider moving the pool off the edge of the bank.
Mr. Wise stated it drops off steeply from the house.
Mr. Palmatier did not feel it would fit if they have to stay to feet from the
building because.of subdivision regulations.
Mr. Rosenberg pointed out they are cutting into the bank and breaking the integrity
of the bank on both sides.
. Palmatier stated the significance of the coastal bank is the 'storm damage
prevention flood control ; it is minimal significance here, no waves reach the
cove.
Mrs. Simmons stated she would hate for that bank to slip and have Mr. Wise lose
his house. fir. Palmatier disagreed and suggested erosion control plantings.
Mrs. Simmons asked i f he would consider moving the pool or did he want the
Commission to rule on it as it is.
Mr. Wise stated, if familiar with the site, no matter where they put it, it
will be on the bank. i
. Coffey asked if they would consider pulling the pool closer to the house.
Subdivision control is usually for fire access and a pool wound not apply if a
question f a variance. He proposed compensatory erosion plantings on the down
side of the pool .
Mr. Palmatier felt compensatory erosion control measures were sufficient as there
will be no disturbance in that footprint of the pool .
Mr. Coffey stated he could see the pool having to be drained down completely if
the wall cracks in a freeze, as freeze it must where exposed with the above
ground edge. He would be more comfortable if pulled back. He asked if it could
be beamed.
