It is not
question of prohibition but a question of the extent of the
jurisdiction of the commission. The Commission has no
jurisdiction outside the 100 foot area with only limited
exceptions,
Mrs. Kilty, 281 Cranberry Ave. , stated they have been t
every meeting and cannot see why a variance is requested and
is surprised with water coming into the area that this would
come about at such a close date to that arrival. She does
not want to create more problems with the pond.
Mr. Rosenberg pointed out there is no variance being
discussed, he is before us because he is within our
jurisdiction. He has the right to build the house without a
variance, none is required. The Commission has no authority
to grant variances, they are handled by the Board of Appeals.
Mr, Roberti stated they went to the Board of Health for the
variance as they have strict guidelines for setbacks.
Mrs. Kilty asked i he was' asking be closer the pond
than normally allowed and was told he was not. She thought
it was in different letters the building was to be located
closer to the pond.
Mr. Coffey thought thee was a reference to either 70 feet or
1 feet in different plans, so the building has moved back
and forth.
Mrs, Kilty stated it was more towards the street in the
original pians which seemed great and all of a sudden that'
have been changed instead of staying closer to the street and
further away from the pond. It has been moved closer to the
pond because of the septic.
Mr. Roberti stated when they originally came before the board
the septic system was within 100 feet of the pond and the
house way up. In terms of en irorimental safety, it is more
safe to have the house within 100 feet so they had to flip-
flop and moved back to reach the limit they are at now with
the septic well over 100 feet.
Mrs. Simmons pointed out when the house was forward the
septic tank was in the gear of the house which was worse.
Mrs. Kitty stated there was no way that was allowed, that was
put out immediately.
