A <br /> - S21, 1 C3N <br /> M !!&H a C:ON, <br /> ti <br /> 1. ng f Sut 24 , 3. 989 <br /> PROPOSED REGULATIONS <br /> Commissioners present: Gertrude Simmons , V, Louise Behrman, Elliot <br /> Rosenberg, Joseph Burns, Patrick Coffey, Harry Desrosiers. <br /> The Meeting was called to order at 6: 18 p.m. <br /> CHAIRMAN: die realize your have a great deal of concern with Regulation <br /> H that deals with Chapter #1 and we want to make it very clear to your <br /> all that we have no intention of passing this regulation into our town <br /> bylaws until the state has pint their regulations into effect which <br /> will probably be around January 1990. We will probably mirror what <br /> the state regulation says; it will be up to the Commission at that <br /> point to review the state regulation. <br /> Chapter 91 has been in effect since 1866 and the State has <br /> decided to update and enforce it. We are not able to ask less in oUr <br /> regulation than the Mate does. We would advise you all to crake an ' <br /> effort to go to the State' s public hearings, make a written comment if <br /> you' re not able to attend the publ id hearings. Don' t just object to <br /> the law, ,give them ideas of things that you can live with because it <br /> is very important that there be some regulation of the structures that <br /> are in our waters now. We have to be able to protect everybody' s <br /> rights and the use of the waters are becoming more and more dealt upon <br /> and you can all realize we have to know what is these so we can deal <br /> with what other people want to put there. <br /> Because of the size of the - group, I ' m goinS to give you a few <br /> ground rules. If you will please come forward so that we are able to <br /> take your comments. We would lime to trap-scribe them as soon as <br /> passible and send them on to the Mate. If you' re speaking for a <br /> group, please identify yourself and the group and the number of people <br /> in your group. As an individual , please identify yourself and give <br /> your address. Limit your comments to one subject please and li ft. <br /> yourself to three minutes. We have one hour and would like to be able <br /> to hear you all . We are here to listen to you, not to get into a <br /> d i al ogue or make comments, Thank your <br /> RICHARD HALPERN, Great Neck Toad: I as an Assistant Harbormaster and <br /> an alternate on the Board of Appeals. I think you may all have a copy <br /> of the Town bylaw in front of you. The section we are talking about <br /> is 4. 3. 8 which is your section of making regulations. That section <br /> states regulations, after a public notice, whIch 1 assure is five <br /> day's, is that correct, and a public hearing, which is what we' re <br /> having today, the Commission shall promu lSate rules and regulations to <br /> effectuate the purpose of the bylaw. Is that correct? <br /> CHAIRMAN: That' s what it says. <br /> µH L_ E 1= Purpose, now the word purpose of the bylaw is defined in <br /> Section 4. 3. 1 .
