August 24, 1989 <br /> Proposed regulations <br /> Page 2. <br /> HALPERN: Section 4. 3. 1 defines the purpose and says the purpose of <br /> this bylaw is to protect the wetlands, related water resources and <br /> adjoining land area in this municipality by prior review. The word <br /> prior~ review implies a review prior to establishing is prior to doing <br /> soe .hing, not past review but prior review. It implies that the <br /> regulation is for future things where you are going to review sore- <br /> thing that is Soin8 to happen in the future. It is my feeling that <br /> some of these regulations are involved with things that were done <br /> before and therefore do not fall under the purpose of the bylaw and <br /> because of that I feel that in order to do this requires a Town <br /> meeting vote in order to change the purpose of the bylaw, to take <br /> prior out and make it past. <br /> BOB A THI : I am here on behalf of South Cape Beach Association. I <br /> air on the voting committee. The area I 'm questioninS is the licenses <br /> by D.E.P. <br /> CHAIRMAN: Any specific regulation? <br /> AUTHI : The specific one is what is required to have a license. n <br /> other words, I ' ll give you an example, let' s assume that you have a <br /> cement cramp in the water that was probably in existence prior to <br /> anyone owning land there; it was put in by the developer back in I # <br /> I know back then they probably didn' t have an active DEQE so we know <br /> there were newer any permits, so it was always just ,put in and so <br /> forth. Now, we as an Association who have taken over that land which <br /> h <br /> is a green area and have assumed the responsibility of that cement <br /> ramp, are we obligated as an association to file for a permit with <br /> DEP? <br /> CHAIRMAN: This is a question you would need answered. <br /> UTHIE # We assumed the taxes on the green area, it is on the green <br /> area, it abuts the green area _and it was the builder who originally <br /> put it in there, not the association, yet we do have title to the land <br /> today. <br /> The other thing I would like to know is, if we are obligated as <br /> an association to file, the licensing part is the one unclear in my <br /> mind. Is this a license with DEP that every year has to be renewed <br /> for a fee? Is there a yearly fee? <br /> SEIF : There is no such provision in the proposed regulations no, <br /> There is no yearly fee proposed in the proposed state regulations. <br /> i <br /> A THIS : In other words there will be one fee, the original applic- <br /> ation fee and there will be no other fees thereafter. <br /> ROSENBERG: So far as I know, that's the present status of the draft <br /> r6gulations published by the state. There is no annual fee. <br /> ATHI It sees to me there is some place in the notes that I did <br /> read about an annual fee but your fee l ing is that there isn' t so I <br /> will accept that. <br /> HAI MAW I think they state 25 years. <br /> AUTHI : That would be different. I thought that in order to control <br /> there would be a licensing fee, that every year you would have to pay <br />
