onm
August 31, 1389
Page
Atty. Connolly stated this has been an expensive learning
process for thea but they have picked it up now.
Kay Berry, 27 Riverside Road: Anybody today must know there
are rules and regulations and with the trouble Mr. Bur-tis has
had, she did not understand why he did not come before this
Board first. Either there are rules and regulations to be
enforced or there are not. If there are not, she is going to
start filling her beach in with sand if nothing is dome about
this situation. If there isn't a penalty behind this, she i
going to get a couple of loads of sand. There were three
empty trailer trucks coming out of the Boatyard one 'night
that had just dropped off some blue stone dust. The land has
been built up 2-3 feet from the natural contour doom by the
water, probably not much more than 40 feet from the water.
inny Driscoll, across the street f rom the boatyard: she
reinforced what was said by Nis Perry. Mr. Burtis has been
Dere long enough to know there are rules and regulations.
Everything was done after the fact. If he can do it, she
felt she could do it too. She stated there are a couple of
gas tanks on the site and she wanted to be sure they do not
underground.
Mr. Sherman advised he spoke with the Bu rt i se s and their
attorney and they are aware a Notice of Intent and MPA
. review will be necessary for the tanks.
He further stated what the Brtises have done in the past has
put the Commission, and himself, in a► very bad position.
The things they have dome, if they went through the proper
channels, would not have engendered a lot of concern. He was
concerned with the permeability of the new stone dust and
composite stone. Also, he would like to sit down with the
- Burtise , regardless of the outcome of this RDA, to talk
about the process of washing of boats and other operational
procedures.
On behalf of the Burtises, of late, since he spoke with
Jonathan on ,duly 19th and a memorandum of understanding was
signed, cooperation has been goon. What has done on in the
past does not engender a► lot of confidence and they Must work
closely together, not ony with what goes on at the boatyard
but on client's projects with docks and so forth. Perhaps in
working together, they won't be coning in under adverse
circumstances anymore. The past is palest, but he feels the
Burtises should have known since they are in the business;
they should have filed. It's a regretful situation that they
didn't.
