5) <br /> CONSERVATION COMMISSION <br /> MEETING of DECEMBER 28, 1989 <br /> Commissioners present at 7:25 p.m. were V. 'Louise Behrman, vice Chairman; <br /> Harry Desros ierrs and Patrick Coffey. Ms Behrman was Chairman Pro Tem in <br /> the absence of the Chairman. Appointed member Richard Halpern was present <br /> but had not been sworn i n. Associate Member Elizabeth Perry was called in <br /> to sit for a quorum. <br /> The meeting was called to order; at 8: 14 p.m. upon arrival of Mrs, Terry. <br /> 7:30 John' s Pond Estates, Pond Circle. <br /> CONTINUED TO MARCH 2 , 19905 AT THE REQUEST OF THE APPLICANT. <br /> 7:31 Paul & Ann Ke n, for the proposed construction and maintenance of an <br /> elevated walkway and fixed pier at 136 Captain's Row* <br /> George Thorng of Arrow Engineering presented abutter receipts. The <br /> proposed elevated a l way and fixed pier to be of pressure treated wood, <br /> 8 feet in total length, 5 feet above the marsh as required by DER. The <br /> pier is to be fixed to prevent it from sitting on the bottom of Nash pee <br /> River at low tide. Board of Appeals approval has been received. <br /> Ms Behrman stated the water is very shallow and asked if this is not a problem <br /> with boats? Mr. Thorng stated he believed so but it is the lesser of two evils, <br /> a choice of having your dock and boats as opposed to just the boats. <br /> Ms Behrman expressed concern with the impact on the ecosystem and boat scouring. <br /> She asked if there were proposed mitigating atin measures and Mr. Thorng had none. <br /> She also asked when the retaining wall was built and was told it is existing, <br /> date unknown. She then asked if there was an order of Conditions for this lot. <br /> Mr. Thorng stated not to h i s knowledge. <br /> Mr. Sherman advised the application is as a result of detection of work in <br /> progress. The dock had been taken out by high tides at various tires; it is <br /> part of an o 1 d existing structure. <br /> The Shellfish Warden advised the eastern side of Great River is a s oftsh e l l <br /> clam area; he has not found shellfish past the low tide marl. The river is <br /> murky and he d i d not fee l scouring wou l d be a problem or that boating in the <br /> area wil.1 increase by this one project. He would not want to see boats tied <br /> up along the fixed p ier and grounding out on top of the shellfish; this was <br /> agreed at Board of Appeals. <br /> Ms Behrman asked if a railing on the side could be installed to discourage a <br /> boat on that side. Mr. Thorng would be willing to come up with a solution. <br /> A railing is proposed up to the fixed walkway on either side, it could be <br /> continued. <br /> Mr. Coffey asked if a smaller pier would be a consideration. Nor. Thorng <br /> advised Mr. Leon owns a 26 ft. boat which is the reason for the 30 ft. pier. <br /> The distance to Mean High Water is 2-112 ft. <br /> Ms Behrman asked the depth at Mean Low Water and was told the soundings were <br /> done at low tide. It will be right on the bottom at low water. <br /> Mr. Caffey asked how it will be installed? Mr. Thorng stated a small barge <br /> with a crane and a pile driver~; fixed 4 X 4 posts in the marsh will be in- <br /> stalled by hand with a porthole digger; 8 inch diameter piles past the harsh <br /> to the end of the fined pier will be driven to rejection, <br />
