Conservation Commission
January 6, 1994
Page 4.
Mr. Sherman asked how many inches they would have at Mean Low water's
Mr. Mclevish pointed to a .dine representing six inches at Extreme Mean Low water
which is one-half foot lower than Mean Low.
Mr. Gray stated the other alternative was to have a shorter structure with
mooring facility in deeper water; Mr. Blasenak did not like that idea and decided
to take the option to go with the longer structure. The structure existing in
the past was causing problems with impacts to shellfisheries and the sediment.
It was well documented to the previous Shellfish warden and the Conservation Agent
that there has been prop dredging and prop wash effects. They are in deeper water,
but not much more than previously. He feels they are in a situation where the
Commission will not be in a position to approve what is on the table. He asked
to extend the hearing to allow him to discuss this further with Mr. Blasenak to
convince hien to take a second look at the shorter structure and mooring facility,
rather than face a denial situation and have to go through months of appeals.
Mr. Sherman stated a shorter structure with no motorized craft. Mr. Gray stated
if Mr. Blasenak burs into the other option, it would be the dinghy dock. He gets
the feeling that if they cant t get to deeper water the Commission has ample doc-
umentation to prove that this is detrimental to the shellfishery. Rick York has
indicated he is not comfortable with- the proposal the last time and they have the
same proposal now. The Blasenaks have to accept what the Commission will allow
for that particular parcel. If they don't want to accept that, they can core
back at the continuation and throw this plan on the table and the omission can
decide hoer to deal with that and then the lasenaks carr decide what they want to
do about it. He and Roger can't improve on this plan, they don't have the water
depth and do not have the ability to extend further to get that water depth. He
only sees in his own mind, to shorten the structure and go with a dinghy facility
with a mooring. He has seen the pictures relative to the enforcement and they are
verb vivid, as far as the damage.
1
Mr, Homeyer stated it is even shallower than before because the storms washed in
so much sand.
VOTE: Motion made and seconded to continue to January 20, 1994 at 8;10 p.m.
CONIDIM TO JANUARY 20, 1994 - :10 pin.
Ted Tiess and Charles Peterson advised they were in the outer room gaiting for the
hearing to be called for the John!s Pond access ramp facility. The Agent apologized
for not announcing this. The Commission agreed to hear these gentlemen after the
'hearing agenda was completed.
VOTE: Motion made and seconded to hear Mr. Tiess and Mr. Peterson at :00 p.m.
7:40 NEW SEABURY Co., LP to continue Regional Beach I ourishment ,program along
Nantucket Sound consistent with the programs as outlined and implemented under
SE 43-936.
