' If they re_move it, he does not see any- sense in their <br /> filing. He has a letter froni -the Cronans statiAg+.,t ey woad rem v' e the float <br /> and then file -for Chapter 91, as he indicated. <br /> V=: Motion made and' seconded. to issue a fine to Patricia Cronan and send <br /> a copy of the letter along with the fine. Unanimous Note, <br /> Jermyn: Mr, Sherman advised an inadequate plan was received from Paul Lelito. <br /> He was in `ormned -by Mr. Jermyn today that this is as much as he will. do and if <br /> not adequate to take it up with the Cranberry Growers Association. <br /> Recommendations received. from Fish & Wildlife and SCS are that he should replant <br /> the entire bank that was disturbed. <br /> He spoke with Elizabeth Lane today and she thought that the Commission had <br /> good case that he obviated his exemption by not having used siltation and not <br /> getting the other. necessary permits, <br /> Mr. Sherman felt the Comrussion should go after Mr, Jermyn, but keeping in mind <br /> it is going after the Cranberry Growers Association. It will be a long drawn out <br /> and. bloody battle. He suggested meeting with the selectmen to show them the slides <br /> f the devastation and see if they concur. <br /> 1 .r. Desosiers asked if Mr. Jerrnyn admitting that he did this. If the Commission <br /> goes after him and loses, they would lose totally. <br /> Mr. Sherman stated someone is going to have to bite the bullet and go after the <br /> growers, it right as well be the Commission. It is not normal maintenance. If <br /> you do not follow the normal maintenance procedure, part of which says you rmust <br /> use erosion control, as deemed appropriate, and you obtain all other state and <br /> federal permits. According to Don Liptack, he should .have taken some action <br /> through the new security act of USDA which he didn't; he didn't contact anyone. <br /> He advised Army Corps of Engineers is coming down. Mat Schweissberg is coming <br /> down from EPA. <br /> Mr. Sherman would like to issue an enforcement order as he is over the <br /> time 1IM't given by letter. A revised revegetation plan to be ordered. <br /> E Motion made and seconded to issue an enforcement order to Dr. Herman. <br /> There being no further business to come before the Commission, the meeting <br /> was adjourned at 10:35 p.m. <br /> Respectfully submi <br />
