Sherman advised that while i he wasdoing a survey of the waterfi nt with his
boat he saw
there were r two large boats on the dock. There were no conditions
re location or boats 'or restricting thy.
1r. Benway stated he just received correspondence from DEP. Half of the paperwork
in his file is due to an abutter, Mr. Franeoeur.. ,
r
Nor. Sherman advised hi's comments had nothing to do with the abutter.
Nor. Benway has sent an as-built to 'DEP.' He stated at no time in the ffainutes was
there any restriction about boats on the outer end of the pier. Vegetation here
is zero. There are some softshell clams that he put in himself, not near the boats.
Mr. Benway stated he is looking for a compromIL-se. He offered to cut the float
down to the size it originally was shown on the plan, cutting off 21 s.f. and then
he would comply with everyone. They could moor along side or do anything- they
want. He would accept a letter to DEP limiting the tying up of boats with the
stern up against the float outward; they do that now. Ir. Sherman agreed they
are moored stern out. The boats are wooden and they would not want thea resting
on the bottom.
Ir. Sherman provided a plan showing water depths, Mr. Benway stated they do not
sit on the bottom t alb. there. The sailboat draws -12 feet and. is in ,rater all
the time. The float is also in that find of water and the sterns of all the boats
are tied up to the float itself and they back out.
Mr. Homeyer stated there is a three knots tide float down the river.
Mr. Sherman stated Mr. Benway may well be correct in that if he goes lack to the
original+float size and he doesn't have to file With DEP or the Commission, the
onm fission's comments would be meaningless. He will tale with Jeff Leonard.
Mr. Sherman asked if there was any possibility of, getting the boats into deeper
water or do they have to go in as far as they do? The bows are in fairly close.
Mr. Benway stated they snug them up right to the Float; there is not 4 - 5 inches
between the float and stern of the boat. He cannot move the float out any further.
Mr. Sherman asked the length of the two boats? They are 25 feet and -35 feet,
Referring to the plan, if 20 foot scale, the 35 foot boat would come to lean Low
Water and the 25 footer would come to the one Foot contours if the plan is accurate
for depths.
Hr. Benway stated there is always 15 feet of water ahead of the largest boat up to
Mean Low Water mark.
Mfr. Homeyer asked if he had ever had a problem with the bow being in the mud?
He stated he hadn't.
Dr. Sherman suggested taking this under advisement and going out at the next low
tide to take a loot . Mr. Benway stated there is no vegetation there.
Mr. Homeyer stated he did not see a problem as it will be specified stern to only.
Nor. Desrosiers and Mr. Johansen agreed also.
