Motion carried. Mr. Madden asked what would happen if the shellfish warden does not provide the report. He was told it would he closed based on the information at the disposal of the Commission. He stated they will need Board of Appeals permit. Mr. Sherman stated that might not be necessary. He will confer with the Building Inspector. LOSER PENDING. 7: 10 PENINSULA COUNCIL, Nadine Place Road, continued from May 19, 1994 . The applicant asked for a continuance . CONTINUED TO 14 JULY 1994 AT 7:00 P.MEN 7: 20 JOHN GILLIS for a Determination of Applicability on the permitting with maintenance in perpetuity of ars existing deck, cement wall and seasonal pier at 18 Shorewood Drive. Mr. Gillis presenting. Ice damage has occurred to the wall and pier. Mrs . Ferriday asked how the deck would be shored up and was told with cement blocks and 4 x 4 ' s, 14 feet long. Mr. Sherman stated the structures predate the act, therefore a Negative ative etermination could be given on that basis. He asked if the cement block wall is touched by water and was told that at normal levels it is not. Public comments were requested; none . VOTE: Motion rade and seconded to find a negative determination with the conditions for main- tenance in perpetuity.
