Motion carried. <br /> Mr. Madden asked what would happen if the shellfish warden <br /> does not provide the report. He was told it would he closed <br /> based on the information at the disposal of the Commission. <br /> He stated they will need Board of Appeals permit. Mr. <br /> Sherman stated that might not be necessary. He will confer <br /> with the Building Inspector. <br /> LOSER PENDING. <br /> 7: 10 PENINSULA COUNCIL, Nadine Place Road, continued from <br /> May 19, 1994 . The applicant asked for a continuance . <br /> CONTINUED TO 14 JULY 1994 AT 7:00 P.MEN <br /> 7: 20 JOHN GILLIS for a Determination of Applicability on the <br /> permitting with maintenance in perpetuity of ars existing <br /> deck, cement wall and seasonal pier at 18 Shorewood Drive. <br /> Mr. Gillis presenting. Ice damage has occurred to the wall <br /> and pier. <br /> Mrs . Ferriday asked how the deck would be shored up and was <br /> told with cement blocks and 4 x 4 ' s, 14 feet long. <br /> Mr. Sherman stated the structures predate the act, therefore <br /> a Negative ative etermination could be given on that basis. He <br /> asked if the cement block wall is touched by water and was <br /> told that at normal levels it is not. <br /> Public comments were requested; none . <br /> VOTE: Motion rade and seconded to find a negative <br /> determination with the conditions for main- <br /> tenance in perpetuity. <br /> NEGATIVE DETERMINATION WITH CONDITIONS. <br /> 7: 30 ROY F EI E I N oN for a Determination of Applicability <br /> on the permitting with maintenance in perpetuity of existing <br /> concrete walls and existing seasonal pier at 14 Shorewood <br /> Drive . Ms H ourihan <br /> presenting. <br /> Mr. Sherman stated the project fits within the performance <br /> standards but is so close to the top of the bank. He <br /> suggested a meeting at the site with the builder and the <br /> June 16, 1994 - Page 4. <br />
