He felt <br /> information was sufficient to close . <br /> Mr. Homeyer stated the Commission has 21 days to make a <br /> ruling. If Shellfish does not comment, it is not a► concern <br /> to the Warden. <br /> Mr. Johansen would close; he had no concerns. <br /> Mr. Green stated it could close, he did not need more <br /> information. <br /> Mr. Sherman stated the Commission would be remiss to close <br /> without all the information. Mr. Homeyer stated it would be <br /> remiss not to act in 21 days. Mr. Sherman stated, for the <br /> record, he totally disagrees with this approach. <br /> Mr. Averett would close the hearing. <br /> Mrs. Ferriday would close pending the report from shellfish. <br /> She stated a letter should be written to the Shellfish <br /> Commission with a copy to the Selectmen. <br /> Mr. Lopez thought the Commission should wait for the report. <br /> Ms Lannik would close pending receipt of Rick York' s report <br /> and agreed a letter should be sent, <br /> Mr. Madden suggested a preconstruction meeting with the Agent <br /> and Shellfish Warden, have a shellfish survey done , keeping <br /> in mind that the existing portion of the pipe piles is an <br /> amnesty component; they are going in the same location. When <br /> they get past the intertidal zone, the shellfish component is <br /> greatly reduced. Between Mean High and Mean Lost is where <br /> everything exists today. The new work is proposed landward <br /> of Mean High Water. <br /> Mr. Sherman stated the Commission should wait for fir. <br /> York' s report because they are sworn to uphold performance <br /> standards that are very specific . Although Stich is remiss in <br /> not providing a► report to us today, he has the credentials to <br /> give the information on land under the ocean, to minimize the <br /> effect on water circulation, eel grass, water duality, <br /> sediment changes, etc . , which can only be done with an on- <br /> site inspection of someone qualified. If received in two <br /> weeks, it would still be within the 21 days. <br /> VOTE: Motion made and seconded to close pending receipt of <br /> information about the vessel to be moored at the float <br /> and the stops to be put on the float, and the shellfish <br /> warden ' s report; at the next meeting after receipt. <br /> Mr. Homeyer was opposed. <br /> June 16 199+ - Page 3. <br />
