will be replaced in kind in the same place .
Mr. Desrosiers asked how high above the beach grass the
structure would be and was told five feet.
Concerning property line issues, Mr. Sherman stated if there
is a change with Chapter 91 , they would have to come back to
US.
Mrs. Ferriday questioned the 150 s . f . increase in float size?
Mr, Madden stated they will get the enlarged float licensed;
it is 10 x 30 vs 6 x 25. It will be licensed per this plan.
Mr, Desrosiers stated the Commission has maintained a 200
s, f . float requirement.
Mr. Madden stated he was sure his client would be willing to
downsize the float,
Edward Caulfield who has resided at #413 for 34 years stated
there are shellfish there. He applied for the amnesty and
had to be 25 feet from the abutters. His concern is the
height of the project.
Ms Lannik stated the Commission cannot address view. DBP is
the governmental body who wants it raised.
Mr, Caulfield asked that this discussion be included in the
record. Tuve Bailey, the assessor, had told Mr. Caulfield
the reason he was taxed so high was because of the view, now
there is an obstruction in his way. He will go back to Mr.
Badley and have his taxes reduced, A photograph was shown of
lois view to the Vineyard.
Mr. Sherman read a letter from Mary Francoeur into the
record. She also voiced objection to the obstruction of her
view, location and size of the float, and the fact that it
sits on the bottom. There are quahogs in the area.
Mr. Madden advised the boat that will be docked there is a 26
foot Pursuit Tiara with a► draft of 18 inches . The major
reason for extending the float is for the purpose of
adequately docking the boat at the pier. The float is held
in place by pipe piles and if replaced with 12 inch dolphin
piles, they would be able to reconfigure the float outward a
little without changing the location. The float will not be
stored on the marsh; it will be taken landward, up to the
garage. This may be difficult and he may have to hire the
boatyard to keep it there . He will be controlled by
conditions.
Mr. Madden stated Chapter 91 will not act until they have a
formal filing in front of them.
Mr. Homeyer asked if the dolphin piles were three put
together? They were not, they were four single piles.
Mr. Madden stated Chapter 91 will condition things on the
pier itself; Army Corps has significant reps also which have
to be complied with. If the concern of the Commission was
June 16, 1 - Page 2.
