Mr. Desrosiers met with the Selectmen and received their
backing to pursue the Robinson and Jermyn violations. It was
suggested to talk to Town Counsel about recouping court
costs
FILING: Re the Quashnet Water Management Act filing, Steve
Ball will work with the Commission and Assessors Office on
this . Andy Gottleib has provided one of his staff who has
been very helpful to us .
DEFN ; A Certificate of compliance was requested. At the
inspection, cutting of vegetation, which is a► violation, was
noted. They have been doing it for years . There were no
drywe l l s and no lawn conditioned but there was a lawn, He
has hired Lelito. He will remove the lawn, put in downspouts
and file a Notice of Intent.
Mr. Sherman suggested releasing the Certificate as Mr.
Drepanos is refinancing and has provided a► letter stating he
will do this , we could issue and condition that the Notice
of Intent be done by a certain date .
VOTE: Motion rade and seconded to issue a► Certificate of
Compliance to Nicholas Drepanos with the condition
that a Notice of Intent be filed by a► date certain.
POLICY: Present policy is not to give maintenance in
perpetuity without an engineered plan.
Mr. Sherman asked if the Commission wants to make a
difference between fresh and salt water'? Chapter 91 accepts
Negative Determinations. He felt there should be an
engineered plan for salt water structures but was not so sure
for fresh water.
Mr. Desrosiers stated to have ars engineered plan is a great
cost to a person.
Ir. Homeyer stated if a dock has an amnesty license, it has
proved its stability by standing the test of time.
Mr. Sherman suggested the need of an engineered plan based on
where it is. If they want a 99 year license the Commission
should insist upon a Notice of Intent and reserve the right
to waive the engineered plan. He will write a draft policy,
with a check list, for the next meeting.
VOTE: Motion rade and seconded that the Agent draft a policy
on filings for Amnesty licenses, with a check list.
BYLAW CHANGE: fir. Sherman stated he would like to explore
incorporating into the bylaw a Certificate of Compliance for
RDA' s.
Ads Lannik agreed to do so.
INAQUIS HT; The Agent contacted Greg Taylor about severe
erosion problems going right into the wetland.
There are also erosion problems with work done by Lawrence
.net , 1994 - age ,
