June 30, 1994 <br /> Page 4. <br /> Mr. Sherman suggested it would be possible if the water <br /> District would accept an amended Notice of Intent. <br /> VOTE: Motion made and seconded to rewire a Notice of Intent <br /> to proceed with the gas rain. <br /> Mr. Kelly asked the extent of the Notice of Intent and was <br /> told anything within 100 feet of the flood zone . <br /> AUSMOP: Scott went el , acting for the Association, received <br /> permission to relocate sand not in the correct place but did <br /> not follow the order to meet with the Agent and to record the <br /> Order of Conditions. <br /> Mr. Sherman suggested fining AGM because they should have <br /> read the order of Conditions before starting wort . <br /> Mr. went el stated it is his error; the fate of the coastal <br /> area is in the hands of the Commission. He asked the <br /> Commission to not penalize Maushop village as they have a lot <br /> f major issues and the Commission' s help will be needed. He <br /> made the mistake and called AGM to schedule the time; they <br /> did not question hire. <br /> VOTE: Motion made and seconded to fine AGM in this matter. <br /> John Fitzsimmons abstained. <br /> Motion carried. <br /> Mr. Homeyer amended his motion to include that Maushop <br /> Village Trust has been warned of future violations . If it <br /> happens again, it will be dealt with severely. <br /> Mr. wentel stated he has admitted fault and the Association <br /> is s aware . <br /> SHELLFISH: Concerning the Foss dock, the Shellfish warden <br /> stated he had no problem with it. He did not feel it was <br /> necessary to have stops on this. <br /> Mrs . Ferriday wrote the orders and stops are conditioned. <br /> Mr. York had no objections . <br /> Mr. Homeyer asked when he would be updating the maps? It is <br /> on his list but he has been working at getting the seed in, <br /> PULSON T'T : Prehearing matte is .duly 20th, The Commission <br /> agreed they want removal of the sand and complete <br /> restoration, <br /> VOTE: Motion made and seconded to have total restoration and <br /> have sand removal with wetland restoration plain <br /> approved by the Commission. Unanimous vote <br /> SCHOOL BLDG. COMM. : The Agent went to a very good meeting; <br /> Fran Smith of Trout Unlimited was present also . They had <br /> asked for environmentatl. input. <br /> 1 . It is hoped they use innovative technology for waste hatter <br /> and energy conservation. <br />
