Mr. Sherman advised it was an emergency repair of a septic <br /> system, 80 feet from the water. There is no erosion to the <br /> pond. He would recommend a negative determination. <br /> Public comments: none, <br /> NOTE: Motion made and seconded to find a negative <br /> determination, <br /> NEGATIVE DETERMINATION. <br /> BRIAN E. CRABTREE for a Determination of Applicability <br /> on the pruning of vegetation at 9 Tritown Circle. Mr, & Mrs. <br /> Crabtree presenting. <br /> Mr. Sherman advised while on the Barnstable Holding Company <br /> property on Triton Circle he noticed cutting on the adjacent <br /> property and asked them to come in and file. They did not <br /> realize they should not be doing that. <br /> Mr. Crabtree stated years ago he brought to the attention o <br /> the Commission that it was a wetland. He removed a tree that <br /> was damaged and overhanging his property, Shoots are coning <br /> back. <br /> Mr. Sherman had no concerns as long as they realize they have <br /> to make a simple call to the Commission. <br /> Public comments: none. <br /> VOTE: Motion made and seconded to find a negative <br /> determination for Brian Crabtree. <br /> NEGATIVE DETERMINATION, <br /> 7:30 HENRY A. WILDE for site preparation and removal of <br /> vegetation at 108 Waterline Drive South. Mr. Wilde <br /> presenting. He advised he made a mistake in July of 1993 <br /> when he had the lot cleared to build. He did not realize he <br /> had to eget approval to do that. <br /> Mr. Sherman advised the flood zone covers a small portion o <br /> the property; virtually the whole lot is in the Commission,'s <br /> jurisdiction. He has agreed to revegetate most of the area <br /> shaded in. This is going to be a two bedroom house which <br /> fits the nutrient loading segs. <br /> Mrs. Ferriday asked the plants to be used and stated the <br /> Commission can provide a list. <br /> Mr. Sherman stated the Commission could close upon his <br /> consulting with Mr. Wilde on the plantings. <br /> letter stating objection to the project from M. E. Hanska <br /> was read into the record; he is an abutter. <br /> Mr. Sherman stated there are no regs under the state for <br /> LSCSF so there is no legal jurisdiction to do all that he has <br /> asked the Commission to do. <br />
