1 �. <br /> Mr. Sherman stated architectural plans will be needed. He <br /> advised when he was at the site, he noted there has been <br /> cutting on the bank. He asked if this should be addressed as <br /> part of this filing with a continuance? If not, an <br /> enforcement order can be issued. Michael Grotke could <br /> generate a revegetation plan. There is an existing shed and <br /> deck. Mr. Sherman expressed resistance to accepting <br /> additions as RDA's with the problems of nutrient loading. The <br /> Commission could make a positive determination for the <br /> cutting on the bank. <br /> Mrs. Ferriday stated there is a float on the marsh also that <br /> must be lifted up and taken off the marsh. <br /> VOTE: Motion made and seconded to find a Positive <br /> Determination as there is an ongoing violation <br /> and architectural plans for layout of the proposed <br /> structure are necessary. <br /> A Notice of Intent rust be filed with proper plans and <br /> architectural drawings, cutting on the bank and remediation <br /> addressed, and that the float will be removed from the marsh. <br /> POSITIVE DETERMINATION <br /> AFTER NEARING AGENDA <br /> DI LUNA: At issue here, I sent my experts home thinking there <br /> would be no more testimony. without my experts, I aim at a <br /> disadvantage. <br /> FERRIL A : Well,, I wasn't going to have any more <br /> . . .
