12 - <br /> Mr. Sherman asked for a vote to sustain the position that it <br /> is not land in agriculture, <br /> Mr. Homeyer pointed out the members are not here that were at <br /> the last meeting. <br /> . Lopez stated this should go to DEP for a decision. <br /> Mr. Sherman did not want to go to DEP with a divided <br /> commission. <br /> Mr. Desrosiers stated he could not vote for what he would <br /> have to admit under oath that he feels is vague. <br /> Mr. Homeyer moved that the Commission drop this. There was <br /> no second. The motion was lost. <br /> Mr, Johansen made a motion that the Commission uphold their <br /> decision <br /> h ir- <br /> dcision of the other night. Mr. Desrosier's pointed out that <br /> no decision was made. <br /> Mr. Sherman stated he was looking for a motion that the <br /> majority of this commission thinks there is some legitimate <br /> j basis to his interpretation which is the sane interpretation <br /> that Town Counsel has. <br /> VOTE: Motion rade and seconded that the commission agrees <br /> there is some legitimate basis to the interpretation <br /> put forth by the Agent, opposed: Frank Homeyer <br /> Harry Desrosiers <br /> The Motion carried. - <br /> The analysis provided by susana Lannik was distributed. <br /> Mrs. Ferriday stated she would like this settled as this is <br /> going to come up again. Mr. Green agreed. <br /> MIKE MI TO: Mr. Mirto would like to clear some dead wood from <br /> town-owned lard under the direction of the commission. He <br /> would make wood sheds with this. He gets the wood and the <br /> Commission gets a free service. If the Commission is <br /> agreeable, he would like to meet with them next agenda. <br /> Mr. Green stated he would like to have hien in to discuss <br /> this. He advised he and other Mashpee people harvest wood <br /> for their fireplaces. <br /> The Agent stated this would be limited to what the Commission <br /> allows him to take. <br /> Ike syr ala advised Barnstable Town Counsel was against this <br /> practice. <br /> FINES: In order to fine an individual for failure to follow <br /> Orders in an Order of conditions, the schedule wording would <br /> have to be changed. A hearing should he held; language to be <br /> drafted. <br />
