NOTE: Motion made and seconded to find a Negative <br /> Determination for Arthur Burnes. Unanimous Vote. <br /> NEGATIVE DETERMINATION. <br /> 7:20 XASHPEE WATER DISTRICT for a Determination of <br /> Applicability the installation of one piedzometer and one <br /> staff gauge on parcels 9A and 12, Creat Hay Road, Dave Rich <br /> presenting. <br /> Robert Lopez stepped down for this hearing. <br /> It <br /> Mr. Rich stated he did not think it necessary to bring either <br /> installation before the Commission but felt it was in the <br /> hest interest to do so. They will he driven by hand. <br /> Mr, Homeyer asked how they will get the dirt out of the pipe? <br /> They will pump it out; it is like a well point. <br /> Mr. Sherman stated he would recommend a conditional negative <br /> determination but he would like to be out there to see where <br /> they will he going. There is next to no disruption. <br /> Mr. Homeyer asked if they pull them when finished, or leave <br /> them in Mr. Rich stated they can pull them or leave tier , <br /> at the discretion of the Commission. Mr, I omeyer asked if <br /> the Commission would get a copy of the monitoring? Mr. Rich <br /> stated yes, if the Commission wishes , when the pumping test <br /> report is submitted to thea. They are 600 - 650 feet away <br /> from the edge of the wetland. <br /> Mr. Sherman stated the piedzometer '.s going into the wetland <br /> itself. <br /> Mr. Rich advised through the approval process, they will have <br /> to file an E F. The Division of Fish & Wildlife owns the <br /> Land. The well is going in' on town land; the piedzometer is <br /> going on Fish. & Wildlife's property. <br /> Mr, Sherman felt it could be a negative determination if he <br /> has a dance to see it. He asked if conditions would be <br /> acceptable? Mr. Rich agreed. <br /> Public comments: none. <br /> NOTE: Motion made and seconded to find a legative <br /> Determination with the condition there will he <br /> an on-site with the Agent prior to installation <br /> of the piedzometer. Unanimous Vote, <br /> NEGATIVE WITH CONDITIONS, <br /> DAVID S INN for a Determination of Applicability on a <br /> request for After-The-Fact permitting of construction of a <br /> creosote tither retaining wall at 37 Tobisset St, <br /> Mr. Sherman advised he went to coo a Certificate of Compliance <br /> inspection on the adjacent site and noticed the wall . It is <br /> within 10feet of a cranberry hog and within the <br /> jurisdiction of the Commission. The timbers are very old and <br />
