Chapter 3A, Section 1 , concerning impacts on <br /> agriculture.. .. <br /> The hearing is being conducted under Section 8 of Chapter <br /> 172, The Agent reviewed the changes to be made. <br /> An additional penalty section, no. 7, is added for failing t <br /> comply with specific conditions within an Order of <br /> Conditions and any activity .underta en without a valid Order <br /> of Conditions or Negative Determination, <br /> Pursuant to Chapter 172, Section 4. . , a new fee proposed for <br /> request -for Amended Order of Conditions to be 4 # 0 , <br /> rather than the present $60. 00 . <br /> Mr. Fitzsimmons stated he would like to insert the word <br /> "knowingly" in A and B of number 7, Sometimes the Commission <br /> is remiss in conveying t6 the applicant what they should do <br /> and this would leave room for people who are trying to do the <br /> right thing but make a mistake. <br /> Mr. Lopez did not agree. <br /> Mr, Sherman stated most of the time an on-site meeting is <br /> held where things are swelled out. He felt addition of that <br /> word would weaken the regulation, <br /> Mrs. Fe rriday stated if anyone has a question, we are here t <br /> help the public. <br /> Mr. Fitzsimmons stated it is very arbitrary the way it is <br /> worded. <br /> Motion was made to accept the proposed regulatory changes <br /> listed in the two pages as written. <br /> Mr, Fitzsimmons made the motion to insert the ward <br /> "knowingly" in sections A and B of #7, There was no second. <br /> VOTE: Motion made and seconded to accept the proposed <br /> regulatory changes listed in the two pages as <br /> written, John Fitzsimmons Abstained <br /> Motion carried. <br /> PUBLIC COMMENT PERIOD: None, <br />
