- 10 - <br /> Wayne Tavares presented abutter notification receipts. The <br /> plan has been changed for the problems with encroachment. He <br /> has worked out the 50 foot buffer. He would like to open <br /> questioning to the board and continue until he can get <br /> together with the Agent and determine lines. He agreed the <br /> house should be moved. <br /> Mr. Sherman stated it is such a tight lot, it requires a lot <br /> of care. <br /> Mr. Tavares stated the septic can only go in one area of this <br /> site. The lot is 3 . 89 acres. <br /> Comments from Board of Health were that the plan has expired. <br /> Mr. Tavares advised Jack Landers-Cauley has talked with them <br /> and it will be straightened out. <br /> Mr. Sherman stated, if they meet out there and cannot come to <br /> a meeting of the minds, the Commission reserves the right to <br /> ask to have an independent person look at the site. <br /> Mrs. Ferriday stated she could not see the revision <br /> differences between the old plan and this one. <br /> Mr. Tavares stated the garage is different. The first go- <br /> around, he had to observe property lines. He is going to try <br /> to take it right to the property line; the garage has a turn- <br /> around. They will be going before Board of Appeals. <br /> Mr. Sherman stated corners of the house must be staked in the <br /> field. <br /> Mrs. Ferriday asked that the house be down-sized slightly. <br /> Mr. Tavares agreed to take care of the Attestation of <br /> Ownership. <br /> Public comments: none. <br /> CONTINUED TO 13 APRIL 1995 - 7:50 P.M. <br /> 9:10 LEONARD FLORENCE for the demolition and removal of an <br /> existing single family dwelling at 78 Triton Way. Norman <br /> Hayes presenting. They are only seeking permission to <br /> demolish the house. The Florences have agreed to continue <br /> beach nourishment; the order has another year to run. <br /> Two structures will be removed. They will be coming before <br /> the Commission with a Notice of Intent for the foundation. <br /> Mrs. Ferriday asked if they were bringing in fill? Mr. Hayes <br /> advised it will be fenced off and if the cellar hole is not <br /> used, it will be filled and a new cellar hole dug. <br /> Mr. Sherman asked distances to the top of the bank? It <br /> slopes back to the upland. Concerning the retaining wall, he <br /> was told it is an architectural wall which will probably go. <br /> It is a landscape design. <br />
