Mr. Sanicki asked what buffer strip he would like to <br /> maintain Board of Appeals is looping to lock something in. <br /> Mrs. Ferriday asked how far he could rove the septic? He <br /> advised the leach pits are on a master plan with the Board of <br /> Health. <br /> Mr. Sherman stated he could go up another 20 feet. The ACC <br /> is consistent with the top of bank. <br /> Mr. Desrosies asked if the Agent would be happy with a 5 <br /> ft, buffer which can be attained by eliminating the garage, <br /> Mr. Sanicki stated he can eliminate the garage which would <br /> give 22 feet. He asked for guidance from the Commission for <br /> what they want, He can go to Board of Appeals. 1t would be <br /> 60 feet from the salt marsh, <br /> Mr. Fitzsimmons stated if the Commission does not hold <br /> rigidly to the 50 feet from the top of the bank, the next <br /> person coming in will want to do the same thing. <br /> . Sherman asked if he can get 50 feet from the bank and <br /> still be in the realm of what the Board of Appeals would <br /> approve <br /> Mr. Sanicki stated he has a subdivision plan done in 1984 <br /> showing this 17,000 s.f. lot. The Commission originally had <br /> a 25 ft. buffer strip and "may" require 50 feet. This may <br /> now be unbuildabl . He asked if the Commission wants a 5 <br /> foot setback from the old borrow area? 1f the garage is <br /> removed, he can get 22 feet more. He would have to discuss <br /> this with his client. <br /> Mrs, Ferriday stated 15 feet will give minimum habitat; that <br /> is what is being discussed. <br /> Mr. Sanicki asked for a letter stating the buffer required. <br /> OTIC: Motion 'made and seconded that the Anent issue a letter <br /> to Cape & Islands that the design is inadequate for <br /> approval unless the buffer zone is maintained at a <br /> minimum of 50 feet from the top of the bank. <br /> Mr. Sanicki stated they will meet 50 feet from the top of the <br /> bank to the work limit plus 5 feet to the house. <br /> CONTINUED TO 11 MAY 19 - PaM, <br /> HO NIIJ, Mr. Green advised the water District is <br /> planning to pump into a cranberry bog adjacent to 55 acres. <br /> SULLIVAN: Two enforcement orders were issued for work done at <br /> Redwood Circle. <br /> MIRTO PROPOSAL: A legal opinion was received from Town <br /> Counsel.
