This can be fine-tuned with Mr. <br /> Bath, He would recommend closing the hearing with the <br /> parameters mentioned. <br /> Mr. Rosenberg stated he does not see a deck on the plan. Mr. <br /> Bath stated it is a 12'x 12' patio. He wants to put a screen <br /> house on top of the patio, Mr. Rosenberg enberg stated the <br /> Commission would not want to have the whole area cleared but <br /> to provide enough for the patio and access around it. <br /> Mr. Fitzsimmons would like to see the Order of Conditions pin <br /> down the pruning as to how high and the number of trees. <br /> Mr. Sherman stated it is most effectively done by going to <br /> the site and tagging what can be removed. The Screen House <br /> can be conditioned to be placed on the patio* <br /> Mr. Bath asked if the deck could be one foot wider, 131 x <br /> 1311 ? <br /> Public comments: <br /> Ron nway: There is a gully-wash but the plan does not show <br /> gradients or elevations, He has concerns with the drainage <br /> Mr, Sherman stated filling in the erosion channel should not <br /> cause a problem* 1t will be monitored to make sure it does <br /> not cause further damage <br /> Charles Shuck: That beach is under some contesting; they <br /> feel they have beach rights. It is in litigation. <br /> Joe Connors: Selective cutting seems very general, it has <br /> already been cut down there. There are paths and the ban] <br /> has been altered. Thinning has been done. <br /> Mr, Sherman stated the Commission is aware but cannot <br /> determine who has done it to the point of enforcement. <br /> Mr, Shuck stated he has seen Mr. Bath cutting down there. <br /> Mr. Connors asked, as neighbors,, should they know what can be <br /> cut? <br /> Mr. Sherman stated the permitted cutting of the tree caused <br /> damage to some other trees, From now on, it would only occur <br /> with a meeting with Mr. Bath. <br /> Mr. Connors stated the water bads up as the road has not <br /> been maintained. It was a rotary but has been allowed to <br /> deteriorate. Mr. Sherman stated the Commission will be <br /> monitoring the situation <br /> Mr. Connors asked if someone stepped forward to state that <br /> Mr. Bath did the cutting, would that make a difference? <br />
