6/15/95 - <br /> The Agent stated it is not necessary to file with thea as it <br /> is in the buffer zone. <br /> Mr, Hunter advised it is a four bedroom home with attached <br /> garage. The Board of Health has approved the plan provided <br /> town water is provided to the dwelling, Leaching is 100 ft, <br /> from the top of the coastal bank. They were conservative <br /> with the bark, <br /> Mr. Sherman stated staking was fine; top of the bark is very <br /> close, <br /> Mr..- Hunter stated a deck is proposed; they are 50 feet from <br /> the bank to the deck and another 10 feet to the foundation. <br /> Excavation is over 60 feet from the coastal. bank. <br /> Mr. Sherman stated a few feet would be lost with the <br /> construction envelope and asked if they could move the house <br /> back 8 - 10 feet so the work limit i s at 50 feet Mr, Hunter <br /> stated they could move it 5 or 6 feet, His client thought <br /> with the traffic to the public dock at the end of the road <br /> that maybe the house is too close to the road now. <br /> Mr. Sherman requested a revised plan for the 50 ft, limit and <br /> Mr. Hunter agreed; if he moves it 5 - 6 feet, it will be <br /> right at the silt fence. <br /> Public comments: none <br /> VOTE: Motion made and seconded to close pending DEP number <br /> and comments, revised plan and labelling of the NVBS. <br /> Unanimous Note. <br /> CLOSE PENDING, <br /> :2 , BATH to fill and grade, do selective pruning <br /> and construction of a 1 ' x 121 patio at 68 & 74 Quail Hollow <br /> Road. Mr, & Mrs. Bath presenting. Copies of the Arborist's <br /> report were provided, Mr. Bath stated it is a natter of <br /> cleaning up two lots of lard by pruning and clearing away <br /> debris dumped there over the years illegally. They will fill <br /> trench that has developed from water running down the <br /> street. The land is eroding in the middle of the property <br /> and they just want to redirect the water. <br /> Mr, Sherman stated he has worked on this with Mr, Bath and <br /> Mr. Johansen. He went to the site with Ellis Allen, The <br /> Commission's normal policy is that within the 50 foot area <br /> adjacent to a resource, they do not allow any cutting, <br /> however, they do not intend to build habitable dwelling. <br /> Mr. Bath stated that is correct and a covenant has been <br /> registered in Barnstable Registry of Deeds, <br /> 1r. Sherman stated a 1f x 1f patio could be permitted 20 <br /> feet away from the water as a trade-off for not building on <br /> it. Ellis Allen provided a plan for selective pruning which <br /> can be followed but he will meet with Mr. Bath to direct ghat <br /> can be removed. <br />
