However , h i's recommendation and getter falls <br /> short of the requirements of emergency certification under <br /> 310 CMR 10 .06 . 1 asked him if he would like to declare it an <br /> imminent pub io health and safety issue nd file a 10 .06 <br /> request withr us , in which case we could have the ability to <br /> permi t it under the State Act . He did not declare it an <br /> imminent peak .io health nd safety 'issue ; hie said hie stands by <br /> his letter . If the Chief wants to come in and fill '.n an <br /> emergency 10 .06 certificate , we could look at it in <br /> different way . At this point , he has not so it falls short <br /> of the requirements of 10 .06where we would have the right i <br /> State or public official declares it a public health or <br /> safety 'issue . Then we would have the ability to permit the <br /> work to go forward . At this point ,, no one has done so . <br />
