6/22/95
Page 6.
Provisions regarding Presumption that there should be n
adverse effect on wildlife habitat around a BVW , Bordering
Veoetated Wetland that falls within an area of critical
environmental concern , which this does . We Previously
indicated to the petitioners , and I still think we should
continue to hold to that p i.1nt , that a wildlifehabitat
evaluation p rs nt to 310 CMR 10 .60 would be necessary . In
other or s , someone should r s nt a report . We have our
own requirements for wildlife habitat evaluation under
Chapter 172 in our regulations . No report following those
procedures has been submitted . You have some statements by
Don Schall . I know Din Sohl l and I respect him; h is an
excellent t nist w ( WOLK: How about Scott Hecker? )
Scott Hecker 1s excellent . But what you have presented to us
are statements quoted from them , not a report by them .
OLK : I don 't have a thousand dollars , sir , to spend .
S K But we are statutorily LK K This 'is a new statute
from President Clinton ) . And I have not seen that but It
does n 't override the ss hu s tt s Wetlands Protection Act
nor Chapter 172 of the Mashpee Cade
WOLK: I realize that but this is what people are facing
today . This is what people look at today .
SMo not feel that feel that we can accept R
corroborative evi eke nc , even though have suspicions t hat it
may be a Justifiable project , we don 't have the corroborative
evidence from a wildlife biologist supporting that position
and my recommendation to the Commission would be that i
these people will not commit to a continuance where they will
present us with such a report ,, that we should deny without
p r jd'i c e .
TZS ONS: Would any of the Commissions care to comment?
OLK : I think that 's really wrong; I think that you 're
Putting such a burden on us .
S N: It 's what the statutes call for .
WOLK: I think that youOre afraid of the Glasses and that i
why you are doing this .
S 1•MAN : I think your insult is not going ;pted by
myself , 'in front of this Commission .
LK: Then 'll have to go to court . I would like to know
how the Glasses were able to get sand on their beach and I
c n not . . . . I SINN S: Mrs . Wolk ,, you are out of order ) take
out a bush , I cannot out a bush .
SHi N: Then i t mandamus s t against us , if you wish .
