Mr . Sherman has been to the site; it is barely within the jurisdiction of the commission and only under the bylaw . As the diagram shows , on that side of the house , it is 95 feet from the water . Top of the bank puts it all in our Jurisdiction . It is all flat and cannot have any impact on any resource r . Public comments w none . VOTE: Motion.ion grade and seconded to find a negative determination . Unanimous Vote . NEGATIVE DETERMINATION. DOUGLAS A. MOHNS to construct a retaining wall with backfilling in nd plantings above at thetop of the coastal bank at 63 Frog Pond Close . . Sherman advised he met with Mr . Moh s who had come to him with plan to build a retaining ll and coo some plantings 0 in areas of disturbance . He will be above the top of the coastal bank in an area where thereis already erosion and 's amenable o doing Plantings as required . There will meeting in the spring before planting ,, which can be conditioned Mr . Rosenberg questioned the stairwell and was told it i s existing .
