22 Febnmry 1996
Page 16.
Mh. Laue stated the property behind their lot is owned by John Schulenberg of Santuit
Realty Trust and she understands he is the brother-in-law of the John Smith who went to
jail because of the whole problem. It was set aside by the Town when this development
wagod in as open space. It is not buildable property, it cannot be used.
Mr. Rosenberg stated that does not make any difference, it cannot be used but it cannot be
used by her as a dumping ground either for material or water.
lir. Laue stated they have to deal with realities and some are (Iifficuland some they owe
to John Smith who stole incredibly from this Town, $300 K 20 people lost their houses.
This man used this as a dump of a type that has not been allowed for one hundred years.
There are at least, he measured it, 10,000 c.y. of ruse ire this kettle hole. Twenty feet
from heir foundation is the front end of a rued car sticking out; there are chimneys; a
friend of his told him chemicals were dumped there. This is a dump. The embankment of
the dump was so steep with the jagged mem protruding from it, this is directs behind their
house, that he feared that this was not safe for children around there so he neatly, Bob
Sherman will verify that he staked it as neatly as he could, on top of the embankment as a
temporary way to prevent people from falling down the steep slope.
For many gears, people used this as a dump, far worse than the official dump allowed by
the town. This dump is in violation of all laws and this was allowed to continue for a
period of at least five years. It was stopped two years ago by neighbors who would run
over there every time someone would try to dump something. The last time someone
dumped something was about a year ago. This is the situation they face, due to the
excavation of their house which is near the top of the embankment, near this dumping
ground, most of the dumping is not on their property, they have disturbed an area 30 x 30
feet of emb&nl nnent that has been denuded of vegetation clue to the excavation and some
of that has washed down into the bottom of the kettle hole, one-half yard of clean sand. It
is their respnsility but 10,000 yards of probably dangerous refuse, including a Porche,
hay been allowed by the 'fawn for a long period of time. He stated he knew that the Town
has known of this dump because the fwst person that informed hire of it was Bill.Hauck, h
said, "Don't you know that the lot next to yours is filled?", that's how he put it. Now this
m the situation they face, they are Wjing to build a house there and doing the best they can.
As far as the water pipe is concerned the Town does not take responsibility for the road.
The houses are iflegA the roads are
