30 May 1996 <br /> Page 14. <br /> PLAN ACCEPTED. <br /> 9:00 MASHPEE DPW, Great Oak Road, continued from 16 May 1996. This was <br /> continued only for legal requirements on notification. The issues were resolved. <br /> Public comments: none. <br /> Y' 1 L: Motion made and seconded to close the hearing pending receipt of DEP number. <br /> Unanimous Vote. <br /> CLOSED PENDING DEP. <br /> 9:10 GEORGE J. WYSHAK to amend the Order of Conditions for SE 43-1407 to <br /> include a landscape plan for 160 Waterway. <br /> Mr. Sherman advised there was some work done a distance away from the coastal bank. <br /> 'I here is no threat to the resource, erosion would have to go through the house. A letter <br /> from an abutter, Patricia Beran, was read into the record. She included a copy of a letter <br /> from Cape & Islands Engineering which stated Dr. Wyshak's landscaping encroached <br /> several feet onto her lot. Small trees, vines and various other natural vegetation had been <br /> removed. <br /> Mr. Rosenberg stated the problem is complicated as the material removed was in the buffer <br /> zone affecting the wetland; the Commission may have to issue an enforcement order <br /> against the neighbor. <br /> Mr. Sherman stated the lawn is not shown on the plan. It can be stated in the Order of <br /> Conditions that all that can be done is what is shown on the plan; the lawn will have to be <br /> deferred. The encroachment is a civil matter. <br /> Public comments: none. <br /> VOTE: Motion made and seconded to close the hearing with respect to those activities <br /> shown on the plan. Unanimous Vote. <br /> HEARING CLOSED. <br /> 9:20 GERALD EPSTEIN for an Amended Order of Conditions for SE 43-1271 to <br /> permit a change in the proposed septic system for 23 Waterline Drive North. The only <br /> change is from a Bioclere to a Fast system as shown on the plan and approved by the <br /> Board of Health. <br /> I <br />
