30 May 1996
Page 16.
JOHANSEN: He stopped me and said, "Are your ears ringing? I put in a word for you."
I knew where he was coming from.
ROSENBERG: I have a problem that is going to come up this evening. Just reading these
letters over, I think we have a serious problem of Mr. Perkins understanding how this goes.
I read from the latest letter of May 25 to Jack; that is not our function. With that filing, we
have to have all the engineered plans. That was to happen at that'Tuesday meeting.
FITZSIMMONS: We agreed that John should not go. It is inappropriate for any of us to
act individually. Perkins agreed with me. He will tell the Laues they have to file a Notice
of Intent. They want answers beforehand.
FITZSDdMONS: He apologized for not keeping us up to date. He is going to tell us what
happened Tuesday.
SHERMAN: We ought to vote to direct John to follow normal protocol.
FITZSIMMONS: We do not want to treat them any different than anyone else.
GREEN: They cannot file without any plans.
JOHANSEN: There are fors that they will have to sign not to hold me responsible and I
will help them in the office with people around.
ROSENBERG: We are going to be put in a position if we turn it down after helping them,
they will say we fixed it so we could turn it down. That's why we have been asked to tell
them before-hand.
SHERMAN: Town Counsel was highly critical of the way this is being handled; they are
giving it away. We will have to live with it later. They are selling us down the river.
Town Counsel suggested that throughout the procedures be very polite and civil, listen to
what he has to say and if we do not like the way it is being handled, go to the Selectmen or
Bob Whritenour and tell them we do not like the way it is being handles. Giving them
money to comply is outside our domain but the way it is being handled is long ter.
Mr. Perkins was invited in.
10:00 p.m.: Sam Perkins, Counsel of Record in the matter of the Laues. He gave the
background. Things moved fairly quickly with the court and the Judge notified on that
i
