30 May 1996
Page 19.
waive fees for what was done in the interim. They put in sono tube footings and a deck on
the wetland side. The plan should show the top of bank where the deck is and where
septic is.
Mr. Perkins asked for a list of engineers. If someone new has to come in, he asked who
should be recommended? Mr. Sherman gave a couple of names.
SHERMAN: I do not know if it is appropriate to waive fees for work that was started after
I stopped work.
Mr. Perkins asked what fees he was talking about.
SHERMAN: Bylaw only, after the fact would be $120.
JOHANSEN: They knew what was going on from day one. It would have cost him $115.
and it would have been done. Now we look like a bunch of clowns.
Mr. Perkins stated a lot of people have discussed this in town.
ROSENBERG: Here is one of the problems, Page 1 and 2, Page 1 shows 33' from the
existing foundation to the rear lot line; Page 2 shows 49'.
Mr. Perkins stated the plans are only here for a general feel for what is likely or not likely.
He recommended not accepting an informal plan.
SHERMAN: I do not know whether we can stay past 11:00 p.m.; I think the janitors leave
at 11:00.
FITZSIMMONS: On the legal end, the Judge granted a temporary injunction against the
enforcement order.
Mr. Perkins stated even the Judge did not know what he did. The Judge got both sides to
agree they would not do anything inconsistent with the enforcement order. Now Peter
Laue is playing games about the deck. He has been told by everyone that he went over the
line with the deck. Once litigation was filed, the Judge controlled enforcement over the
Laues if they decide they are not going forward. At that point, the ball will be in the
town's court to ask the Judge to go forward.
FfTZSIMMONS: I think we are moving in the right direction.
SHERMAN: I need to get a plan and a letter to get Don Liptack out there.
