3 <br /> MASHPEE CONSERVATION COMMISSION <br /> Minutes of 22 August 1996 <br /> Commissioners present: John Fitzsimmons, Elliot Rosenberg, George <br /> Green Jr. Ralph Shaw, David Sharpe, John <br /> Johansen, Harry D srosi rs and Greg Wirsen, <br /> Associate member. <br /> The Chairman called the meeting to order at 6:55 p.m. <br /> PUBLIC COMMENT PERIOD: lone. <br /> 7:10 MARGO FENN, CAPE. COD COMMISSION, came before the <br /> Commission to answer questions about the idea of creating a DCPA, one of <br /> many recommendations. She spoke on what a DCPC' is. It was one of the <br /> things specked in the Conservation Act and could be done for any d of <br /> resource protection, such as an embayment. There are series of Boards <br /> empowered to make a nomination to the CCC. When received, they are <br /> obligated to hold a public hearing within 45 days on whether to accept the <br /> nomination. During that time, there is a moratorium within the area. In <br /> making the acceptance, they have to specify ghat activities can take place. <br /> They would go through the review process for guidelines for regulations <br /> follow up on. It would go to the County Assembly of Delegates. Where are <br /> public hearings in each phase of the process. Changes might take place in <br /> Zoning. They are local regulations and locally enforced. <br /> Ed Eichner, Cape Cod Commission, showed a map of the Mashpee liver <br /> watershed., Shoestring Bay and the lover part of the Popponesset watershed. <br /> It has excess nitrogen. Mr. Sherman asked if it is 10 times too much? It is <br /> about 4 times. There is a grant proposal made to DEP which DEP did not <br /> recommend that to EPA. The CCC will not be able to dedicate as much as <br /> they had thought. He referred to the draft report. <br /> Nr. Rosenberg asked if when the final report comes out, would they give an <br /> idea of what will be recommended to mitigate the problem. <br /> Mr. Sherman stated if the nomination were put forward and adopted, it would <br /> make it a priority. Also, that would be a catalyst that the Town is doing <br /> something about this. <br /> Mr. Fitzsimmons stated there were not sufficient statutes at hand right now. <br /> Mr. Sherman stated there is the Nitrogen Loading statute. It has to be Board <br /> of Health or Zoning. <br />
