22 August 1996 <br /> Page 2. <br /> Mr. Fitzsimmons stated the Town would have a complete moratorium for 45 <br /> days. <br /> W. Eichner stated during the review it can be specified certain types of <br /> activity can go on. Falmouth has Sippewisset and Black Marsh. <br /> Aft. Sherman asked who makes the decision what can go on <br /> Ms Fenn stated the CCC has to specify but relies on the Town to make that <br /> decision. <br /> Mr. Rosenberg stated, technically, it is out of the TowWs hands. In other <br /> words, the Town sloes not have the authority. <br /> Ms Fenn stated the ultimate authority rests with,the CCC once accepted for <br /> review. It is 45 days and then an two to four -month period for review. <br /> Mr. Sharpe asked if preventing someone from building could be considered a <br /> taking and if it is, would they s be the Town's partner.- <br /> Ms Fenn stated there should not be a problem with taking issues. They have <br /> been upheld by the courts. It has to be shown they are working in good faith <br /> and that there is going to be a moratorium for only a cert aai.n length of time. <br /> W. Rosenberg stated the River extends beyond the boundaries of Mashpee, <br /> how would that be handled? <br /> Ms Fenn stated it is Mashpee and Sandwich. As a Town Board, the <br /> Commission has the ability to nonu*nate an entire watershed even though <br /> another Town is involved. <br /> Nr. W rsen asked if it applied to single family homes during the first 45 days? <br /> Ms Fenn stated the Town is not allowed to issue any development permits <br /> during the itial 4 5 days <br /> Mr. Rosenberg asked what about septic? That would stow for 45 days also. <br /> Where is an emergency provision for public health problems. <br /> Ed Baker asked if there is a DRI application before the CCS, hoer would that <br /> impact the 45 day period and review period re Mashpee Commons and the <br /> Arts Center. <br />
