Until the State has deaf with the appeal, or at least issued, she <br /> felt it would not be reasonable to entertaain a plan amendment under 131.40. <br /> Ms Wilson stated the problem with the Bioclere is it is like a souped up septic <br /> system; she described the working of the system. It takes two to three <br /> months to start removing things from the eluent. It is going to be a seasonal <br /> hone; it is being built for spec. <br /> Mr. Sherman suggested she put her concerns about the Bioclere in writing <br /> and he would run them by George Huefelder. <br /> Ms Wilson stated there are two wed less than 30 feet apart just upgradient <br /> of the septic. Ground water flow is potentially towards the wells and would <br /> likely cause contamination. She recommended before approval that a study <br /> be done. <br /> Mr. Green stated wells are under the purview of the Board of Health. Mr. <br /> Sherman stated it is also with the Commission for private water supply but <br /> the Commission would defer to the Board of Health. <br /> Mr. Sanicki stated it is 50 feet from the top of the coastal.bank. <br /> ?r. Fitzsimmons stated it does not appear to be something the Commission <br /> could deny. <br /> Mr. Sherman stated at the very least, the Commission would have to hear <br /> from the State; he will contact Dan Gilmore to see whether the Commission <br /> can go ahead or not. <br /> Mr. Rosenberg asked if the Bioclere was in the original proposal and was told <br /> it was. They are relocating exactly the same system as has been appealed. <br /> He asked why this would not go to the State? They are either going to turn <br /> down the appeal or allow the appeal; this should be part of they action. <br /> Mr. Sherman stated the Commission dict not have a problem with the Bioclere <br /> originally. He suggested holding this two weeks. <br /> Mr. Rosenberg stated the person who initiated the appeal is not going to be <br /> satisfied. the Commission approves this so this will go back to the State. <br />
