3 October 1996 <br /> Page 6. <br /> Mr. Sherman stated the existing area between the top of bank and patio is <br /> grass. The project meets the performance standards and wetlands act. The <br /> corners of the building will need to be staked. fir. Slavins y stated that will <br /> be done tomorrow. <br /> Mr. Johansen asked if Board of Appeals approval was received. Atty. Iirrane <br /> advised relief was granted and the written decision is to be issued tomorrow. <br /> Mr. Green stated landscaping is not in the narrative and cannot be discussed; <br /> they could cone back with an amended order. <br /> Mr. Rosenberg questioned going to the top of the bank with the work limit? <br /> Mr. Slavinsl y stated it is a grassed area but agreed to bring it back 10 feet. <br /> Mr. Green thought 15 feet was realistic. <br /> 1r. Fitzsimmons asked if Board of Health has to look at this for 5 bedrooms? <br /> Mr. Sherman stated it is already approved for five bedrooms. There will be an <br /> on-site before a Certificate of Compliance is issued. <br /> Public comments: Robert Webster, an abutter, stated he had no objections <br /> but wanted to know if this house is going to be any further forward than the <br /> existing. <br /> VOTE: Motion made and seconded to close pending DEP number and formal <br /> approval from Board of Appeals. Unanimous Vote. <br /> CLOSED PENDING. <br /> 50 ROBERT MARCOUX to Amend the Order of Conditions for SE 43M <br /> 1499 to relocate the septic system components at 14 Fern Dane. Dave Saici <br /> pg. P <br /> presenting. Also resent for this hearing was David Lupo, an abutter, and his <br /> representative, Arline Nilson, who appealed to the State. Abutter notification <br /> receipts were provided. The only change. is the relocation of leaching. They <br /> have maintained the 50 feet from the top-of the bank. The abutting well was <br /> found physically. Board of Health approval was received on September 19th, <br /> The Agent advised no formal decision has been received from DEP. He did <br /> have a conversation with Dan Gilmore and the Commission will Have to wait <br /> for an answer from hien. Ms Wilson raised the point that the does not <br /> conform to Title V and therefore the ming should be reopened. <br />
