1 October 1996 <br /> Page 6. <br /> Public comments: none. <br /> VOTE: Motion made and seconded to close pending receipt of DEP number <br /> and ,i�ration of the time frame for Natural.Heritage and <br /> Endangered Species. Unanimous Vote. <br /> CLOSED PENDING. <br /> 8:10 DONALD L. FERNANDES to construct a garage; pump, fill and <br /> abandon existing cesspool and overflow; installation of Title V system; and <br /> relocation of utility services as required at 9 Seconsett Point Road.. Dave <br /> Sanicki presenting. <br /> Mr. Sherman stated this is a site with a violation by the previous owner. The <br /> septic is failing. The driveway is on the other side from the resource area. He <br /> recommended issuing the Order of Conditions byt have it indicated on the <br /> plan it is river front. It was noted Board of Health commented they had no <br /> plans. <br /> 'COTE: lotion made and seconded to close pending DEP number and Board <br /> of Health approval. Unanimous vote. <br /> CLOSED PETTING. <br /> :20 CARMELA DIMICHELE for construction of a dwenfrmg, garage, deck, <br /> driveway, grater service, utilities and sewage disposal system at 5 <br /> Meadowbrook give. Dave Sanic .ii presenting. <br /> Mr. Sherman stated this is problematical in that the Rivers Act is not clear. <br /> He measured it in the field and it may not be in the river cont area. Where as a <br /> house between this house and the river. <br /> Mr. San cki stated it is a channel, 2 - 3 feet wide. <br /> Mr. Sherman stated it is within 100 feet of the Flood Zone; it is an approvable <br /> project. It is insignificant in terms impact. It is a Bioclere system. <br /> Mr. Sanic i stated this lot does not front a river or waterfront. He has been <br /> told once removed by a house lot wiU not qualify for the Act. He requested <br /> the Commission close the hearing pending resolution of the Act. <br /> W. Johansen asked if they had Board of Health approval and. Mr. Sanic i <br /> advised plans have been approved. <br />
