21 November 1996 <br /> Page 2. <br /> :30 ROBERT MA C UX, 14 Peng Lane, continued from 3 October 1996. <br /> Dave Sanicki presenting. Also present for this hearing was an abutter, David <br /> Lupo and his representative Arlene Wilson. <br /> Mr. Sherman stated a decision was reached given the guidance by DEP that <br /> the Commission could issue an Order of Conditions. <br /> The general consensus was the issues were resolved. The Agent gave the <br /> background of the application. <br /> Mfr. Sanici stated they changed the leaching facility to 50 feet from the <br /> coastal bank. The Board. of Health had approved this contingent upon the <br /> State approval and there is a letter in the file from. the State. <br /> lir. Sherman stated the point was made in Ms Wilson's letter there would <br /> have to be grading changes. Mr. Sanicki stated there will be nothing that was <br /> not shown on the plan. Mr. Sherman asked if grading changes were shown on <br /> the }plan? Mr. Sanicl i stated no. Mr. Sherman stated then none can be clone. <br /> It wiU be conditioned that there will be no grade changes allowed. <br /> Ms Wilson stated she believes they cannot construct what is shown on the <br /> plan without grade changes. In wart of the information provided to the <br /> Commission is a letter from the owner making it clear the property is not for <br /> his use but for speculative purposes. She felt it is only fair to the buyer that <br /> the permits allow real construction. <br /> Mr. Rosenberg stated that is up to the building department. Ids Wilson felt <br /> there are particular issues that are up to the Commission. She would life the <br /> Board to think before issuing any permit. There will be 2000 s. . disturbed for <br /> a septic system that cannot be left disturbed. She stated this will be asking <br /> for a situation where the Board will be into enforcement orders. The nitrogen <br /> loading and ground water issue is pri0me. <br /> Aft. Sherman stated, in his opinion, the standard boiler-plate conditions are <br /> sufficient. Landscaping cannot be done if it is not on the plan. <br /> Mr. Lupo advised there are three abutters who have expressed concern about <br /> development of this property; every i u m requirement is barely net. <br /> Mr. Sherman took offense with Mr. Lupo's comments. Mashpee is the only <br /> town with a. nutrient loading regulation. There is a strict lawn policy also. <br /> Mr. Rosenberg asked if this had Board of Health approval and was told it had. <br />
