Mr. Lupo stated he would assume the Commission has jurisdiction over ground water. Ms Wilson stated if in fact the Commission is going to walk down this path, they should consider a conditions concerning landscaping plans. Mr. Rosenberg stated there is no authority to do that. Ms Wilson stated. DEP would uphold this. Mr. Sherman stated there w l be a pre-work on-site with the contractor and everything will be made clear to him. Ms Wilson stated there is a 3 ft. differential. Mr. Sherman stated if there is a flawed plan, it is not up to the Commission to correct it. VOTE: Motion made and seconded to close with the condition there wiR he no grade changes and no landscaping other than ghat is shown on the plan. Unanimous Vote. HEARING CLOSED. 7:40 o WT OF MASHP E, BOARD OF SELECTMEN, for maintenance dredging of an e3dsting channel in Wuit Bay 800 ft. x 100 ft. and beach nourishing 250cubic yards on Great Neck, on the Commonwealth of Massachusetts Environmental Management Dept. of Forest & Parrs property within the Whit Bay area of Critical Environmental Concern. Norman Hayes presenting. Mr. Sherman stated the project can he approved with dine tuning. There will he an additional pre-wort on-site. Limits where nourishment will he put will he delineated in the fad. Mr. Hayes advised this was dredged in 1986 under an Army Corps permit. They dug 2500 c.y. within the channel and put it on Seconet. There was a change in ownership so they will be going along the beach in Great Neck. It is above Mean High Water, 2 feet on the coastal. hank.
