19 December 1996 <br /> Page 19. <br /> Mr. Sherman suggested two or gree commissioners draft a letter for <br /> consideration at the next meeting and then take a vote. <br /> Mr. I esrosiers stated at past Commission meetings it has been stated that <br /> the Town representative in the person of the Herring Warden had the <br /> authority to raise and lower the level of the pond by boards. <br /> Mr. Sherman advised only incidental to the passage of herring. <br /> Mr. I esrosiers stated exactly, but if he can move those boards without afiling <br /> for the passage of herring, then the precedent has been set. If he puts those <br /> boards in and doesn't rerriove therm after the passage of the herring, the Town, <br /> he feels, will be liable. The only way to prove that will be to go to court. <br /> Mr. Rosenberg stated that is not up to the Commission. <br /> Nk. I esrosiers started it is not but it is up to the Commission on the other end. <br /> Mr. Shaw stated this Commission ssion has been accused of dragging its feet and <br /> not acting on this. <br /> i <br /> Aft. Sherman stated that is wrong; the Commission sloes not have the <br /> authority. <br /> Mr. Rosenberg stated there is only one issue here and it is very simple, <br /> whether or not to include hese two letter, either one or both of hese letters. <br /> Mr. Sherman stated if the two letters are included it will muck up the <br /> situation even more. <br /> Mr. Desrosiers, thought they afl have a copy of therm. <br /> Mr. Rosenberg asked, if they have the letter which says the DPW has the <br /> responsibility, why are they chasing the Commission <br /> Mr. Desrosiers did not believe they are chasing the Commission, he thought it <br /> was getting a bait of the scatter from the buckshot. <br /> Mr. Rosenberg stated the Commission is getting all these letters addressed t <br /> the Commission, not everybody else. He was ting about Nk. McGonagle's <br /> letter. <br />
