Mr. York reviewed the philosophy of the Shellfish Commission/ ; .. <br /> Department, and he stated the 'down is left to decide what they <br /> want. The state is lenient in this area,. <br /> In the course of discussion, it became apparent that there is <br /> a difference of opinion as to whether the Army corps of Engineers <br /> Programmatic General Permit (PGP) applies , or if the setter <br /> of Permission (LOP) applies , <br /> Waterways and shellfish agreed that the objective is to share <br /> the resources without damage to the environment <br /> Mr. Cadrin stated that there aro lagers of permission required <br /> leading to the final permits , and that there are too many <br /> regulations * <br /> Mr, Cadrin stated waterways and shellfish are net in agreement <br /> on: <br /> ( 1 ) performance criteria and ( ) designated areas for shellfish <br /> grants. <br /> Mr, Green stated the Conservation Commission needs to be ,included <br /> in the process , which requires a Notice of Intent (at a cost <br /> of $too ) * He suggested Cons Cori be last because that would <br /> he hest for Cons Com, considering their heavy word. load. <br /> Mari. Burti s stated that he objects to the 300 foot buffer zone <br /> because of the risk that public oh'ect.ions could cause the permit <br /> to he denied, but he can work with the 100 ft. setback regulation <br /> required by the Conservation Commission. <br /> Reqardinq designated areas , 't was suggested tabling the <br /> discussion until the Harbormaster and the assistant planner <br /> can he present. <br /> Mr. Hanks noted there is a problem with monitoring the <br /> productivity, and there is a difference between minimum purchase <br /> of seed and minimum quantity produced. It would he difficult <br /> to get a person off the grant for inactivity. <br /> i' <br /> Mr. Cadrin stated that perhaps a procedure could be defined <br /> for revoking a grant , inc .ud.ing a public hearing , that would <br /> achieve the objective <br /> l: <br /> Everyone agreed that the seed. ( spat) is good apawning for the <br /> Town, <br /> I• <br /> Mr, Cadrin stated the Commission will work on developing the <br /> Regulations at their next meeting. He wants the applicants <br /> to 4o forward with the process and not be held back because <br /> of a moratorium. <br />
